    BATI AND OTHERS v. TURKEY

    Auszug aus EGMR, 21.10.2008 - 30461/02
A description of the relevant domestic law at the material time can be found in Batı and Others v. Turkey (nos. 33097/96 and 57834/00, §§ 96-100, 3 June 2004).

In the instant case, however, the proceedings in question did not produce any result due to the application of Law no. 4616, which created virtual impunity for the perpetrators of the acts of violence, despite the evidence against them (see, mutatis mutandis, Batı and Others v. Turkey, nos. 33097/96 and 57834/00, § 147, ECHR 2004-IV, and Abdülsamet Yaman v. Turkey, cited above, § 59).
