STYRANOWSKI v. POLAND
Auszug aus EGMR, 31.01.2008 - 22775/03
However, in assessing the reasonableness of the time that elapsed after 11 September 1997, account must be taken of the state of proceedings on that date (see Milosevic v. "the former Yugoslav Republic of Macedonia", no. 15056/02, § 21, 20 April 2006; Styranowski v. Poland, no. 28616/95, § 46, ECHR 1998-VIII; Foti and Others v. Italy, judgment of 10 December 1982, Series A no. 56, p. 18, § 53). - EGMR, 27.06.2000 - 30979/96
FRYDLENDER c. FRANCE
Auszug aus EGMR, 31.01.2008 - 22775/03
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII). - EGMR, 25.11.2003 - 41431/98
WIERCISZEWSKA v. POLAND
Auszug aus EGMR, 31.01.2008 - 22775/03
Although the Court is not in a position to analyse the quality of the case-law of the domestic courts, it observes that, since remittal is usually ordered because of errors committed by lower courts, the repetition of such orders within one set of proceedings discloses a serious deficiency in the judicial system (Wierciszewska v. Poland, no. 41431/98, § 46, 25 November 2003). - EGMR, 20.04.2006 - 15056/02
