    KOKHREIDZE AND RAMISHVILI v. GEORGIA

    Auszug aus EGMR, 05.02.2013 - 16380/11
Reiterating its considerations in the case of Sabri Günes v. Turkey ([GC], no. 27396/06, §§ 39-59, 29 June 2012); as well as its decision in the case of David Kokhreidze and Shalva Ramishvili v. Georgia (dec., nos. 17092/07 and 22032/07, 25 September 2012) and noting that, in accordance with national law, the ruling handed down by the Administrative Jurisdiction Division on 24 August 2010 was sent to the applicant on that same day (see paragraph 5 above), the Court finds that the six-month period within the meaning of Article 35 § 1 of the Convention started to run on 25 August 2010 (see Sabri Günes, cited above, § 60).

ANEMA-KWINKELENBERG AND OTHERS v. THE NETHERLANDS

I would draw to your attention that the Court may decide, in the absence of a valid power of attorney, to declare the application inadmissible on the ground that there is no valid application (see Post v. the Netherlands (dec.), 21727/08, 20 January 2009; Kemevuako v. the Netherlands (dec.), no. 65938/09, § 22, 1 June 2010; Çetin v. Turkey (dec.), no. 10449/08, 13 September 2011; Kaur v. the Netherlands (dec.), no. 35864/11, §§ 17-19, 14 May 2012; and Ngendakumana v. the Netherlands (dec.), no. 16380/11, 5 February 2013).

VEB NCVB AND OTHERS v. THE NETHERLANDS

The Registry's fax made reference to the Court's case-law in this respect, in particular to Post v. the Netherlands (dec.), 21727/08, 20 January 2009; Kemevuako v. the Netherlands (dec.), no. 16380/11, 5 February 2013.
  • EGMR, 11.10.2016 - 54940/09

    SEYHAN v. TURKEY

As the application form was only submitted to the Court on 12 October 2009, after the applicable time-limit, the application must be considered to have been introduced validly on that date and was thus out of time (see Ngendakumana v. the Netherlands (dec.), no. 16380/11, 5 February 2013).
