In the circumstances, and notwithstanding the fact that the house was purchased in good faith, as the decisions authorising occupancy did not constitute rights in rem over public property - a fact of which the applicant could not have been unaware, just as he could not have been unaware of the consequences of that for his rights over the house - (see, by contrast, Z.A.N.T.E. - Marathonisi A.E. v. Greece, no. 14216/03, § 53, 6 December 2007), the Court doubts that he could reasonably have expected to continue having peaceful enjoyment of the property solely on the basis of the decisions authorising occupancy (see, mutatis mutandis, Özden v. Turkey (no. 1), no. 11841/02, 3 May 2007, §§ 28-30, and Gündüz v. Turkey (dec.), no. 50253/07, 18 October 2007). - EGMR, 11.12.2008 - 9368/06
THEODORAKI ET AUTRES c. GRECE
- Marathonisi A.E. c. Grèce, no 35859/02, § 36, 13 juillet 2006).
Malte, no 4251/02, § 45, 8 novembre 2005 et Z.A.N.T.E. - Marathonisi A.E. c. Grèce, no 14216/03, § 50, 6 décembre 2007).

PARATHERISTIKOS OIKODOMIKOS SYNETAIRISMOS STEGASEOS YPALLILON TRAPEZIS TIS ELLAD …
Dans les arrêts Z.A.N.T.E.-Marathonisi A.E. c. Grèce (no 14216/03, § 52, 6 décembre 2007) et Anonymos Touristiki Etairia Xenodocheia Kritis c.

TSIOLIS v. GREECE
Rn. 32 The relevant domestic law and practice regarding the protection of the environment and the right to claim compensation from the State for restrictions imposed on the right to property on environmental grounds are described in the Court's case-law, notably in Thanopoulou v. Greece, no. 65155/09, §§ 31-32, 12 July 2011 and Theodoraki and Others v. Greece, no. 9368/06, §§ 23, 26-27, 11 December 2008). - EGMR, 08.11.2018 - 78005/11
MALLIAKOU AND OTHERS v. GREECE
Following the Court's judgments in Theodoraki and Others v. Greece (no. 9368/06, 11 December 2008), Z.A.N.T.E. - Marathonisi A.E. v. Greece (no. 14216/03, 6 December 2007) and Anonymos Touristiki Etairia Xenodocheia Kritis v. Greece (no. 35332/05, 21 February 2008), the Supreme Administrative Court issued a series of judgments by which it modified its previous case-law, according to which every plot of land situated outside urban areas was intended to be used for agricultural activities. - EGMR, 29.03.2010 - 34078/02
BROSSET-TRIBOULET ET AUTRES c. FRANCE
- Marathonisi A.E. c. Turquie (no 1), no 11841/02, 3 mai 2007, §§ 28 à 30 ; Gündüz c. Turquie, no 50253/07, 18 octobre 2007). - EGMR, 06.12.2007 - 14216/03
Z.A.N.T.E. - MARATHONISI A.E. c. GRECE
Grèce, no 35859/02, § 36, 13 juillet 2006).

The Court is particularly struck by the fact that, although the very substance of the applicants" ownership has been affected (see Sporrong and Lönnroth v. Sweden, judgment of 23 September 1982, Series A no. 52, p. 23, § 60), the applicants were not successful in obtaining compensation under Greek law. - EGMR, 20.01.2005 - 37806/02
ASTIKOS OIKODOMIKOS SYNETAIRISMOS NEA KONSTANTINOUPOLIS c. GRECE
Auszug aus EGMR, 13.07.2006 - 35859/02
This possibility was offered to them by virtue of Law no. 998/1979 (see paragraph 23 above), the constitutionality of which had not been questioned at the time when the applicants attempted that remedy; it cannot therefore be argued that when the applicants applied to the Supreme Administrative Court in 1999, they had reasons to believe that their recourse to that remedy would be of no avail (see, by contrast, Astikos Oikodomikos Synetairismos Nea Kostantinoupolis v. Greece (dec.), no 37806/02, 20 January 2005).

PAPAMICHALOPOULOS ET AUTRES c. GRÈCE
Auszug aus EGMR, 27.09.2007 - 35859/02
The Government affirmed that the present case was therefore clearly different from the Papamichalopoulos case, where the Court had found that the State's illegal occupation of the applicants' possessions amounted to a de facto expropriation (Papamichalopoulos and Others v. Greece, judgment of 24 June 1993, Series A no. 260-B, p. 69, §§ 41-42).
