  • EGMR, 03.04.2003 - 43924/98

    KARATEPE contre la TURQUIE

    Auszug aus EGMR, 17.01.2006 - 42576/98
The Court re-affirms its practice, in cases where the domestic law does not provide for the service of a written copy of a final domestic decision, that the six month period in Article 35 § 1 begins to run from the date when the decision was finalised, i.e. when the parties were definitely able to be informed of its contents (see, among many others, Seher Karatas v. Turkey, no. 33179/96, § 27, 9 July 2002, and Karatepe v. Turkey (dec.), no. 43924/98, 3 April 2003).
  • EGMR, 30.05.2006 - 59423/00

    SARL ABORCAS c. FRANCE

    Auszug aus EGMR, 17.01.2006 - 42576/98
The Court reiterates that, when a new complaint is raised for the first time during the proceedings before the Court, the six month period is not interrupted until this complaint is actually lodged (see, Sarl Aborcas and Borowik v. France (dec.), no. 59423/00, 10 May 2005, and Loyen v. France (dec.), no. 46022/99, 27 April 2000).

  • EGMR, 20.11.1989 - 11454/85
    Auszug aus EGMR, 24.01.2002 - 42576/98
The admissibility of evidence is primarily a matter for regulation by national law and, as a rule, it is for the national courts to assess the evidence before them (see the Kostovski v. the Netherlands judgment of 20 November 1989, Series A no. 166, p. 19, § 39).
  • EKMR, 17.07.1986 - 10389/83

    JOHNSON v. THE UNITED KINGDOM

    Auszug aus EGMR, 24.01.2002 - 42576/98
The Court recalls that, according to the established case-law, when the acts of an authority are not open to any effective remedy, the six-month period runs from the date on which the act took place (see, among others, application no. 10389/83, decision of 17 July 1986, D.R. 47, p. 72).
  • EKMR, 06.04.1995 - 24142/94

    RAPPAPORT v. FRANCE

    Auszug aus EGMR, 24.01.2002 - 42576/98
The Court considers that the applicant's complaint in this part should be examined under Article 6 § 1. Thus, there is no need for the matter to be considered in the context of Article 13, which has less stringent requirements (see the Rappaport v. France decision of 6 April 1995, application no. 24142/94, DR 81, p. 108).
