The Court recalls its established case-law according to which an individual cannot be considered to be of "unsound mind" and deprived of his liberty unless the following three minimum conditions are satisfied: firstly, he must reliably be shown to be of unsound mind; secondly, the mental disorder must be of a kind or degree warranting compulsory confinement; thirdly, the validity of continued confinement depends upon the persistence of such a disorder (see the Winterwerp v. the Netherlands judgment of 24 October 1979, Series A no. 33, pp. 17-18, § 39, and the Johnson v. the United Kingdom judgment of 24 October 1997, Reports 1997-VII, pp. 2409-10, § 60). - EGMR, 05.11.1981 - 7215/75

Im Sinne von Artikel 5 Abs. 1 Buchstabe e kann einer Person wegen einer psychischen Erkrankung die Freiheit nur entzogen werden, wenn die drei folgenden Mindestvoraussetzungen vorliegen: Erstens muss die psychische Erkrankung zuverlässig nachgewiesen sein, d. h. eine tatsächliche psychische Störung muss aufgrund objektiver ärztlicher Fachkompetenz vor einer zuständigen Behörde festgestellt werden; zweitens muss die psychische Störung der Art oder des Grades sein, die eine Zwangsunterbringung rechtfertigt; drittens hängt die Fortdauer der Unterbringung vom Fortbestehen einer derartigen Störung ab (…siehe Winterwerp ./. die Niederlande, 24. Er ruft in Erinnerung, dass die Vertragsstaaten in solchen Fällen bei der Anordnung von Dringlichkeitsunterbringungen über einen weiten Ermessensspielraum verfügen ( Sache X ./. Vereinigtes Königreich , Urteil vom 5. November 1981, Serie A, Band 46, S. 18, Randnr. 41, und Varbanov ./. Bulgarien , Nr. 31365/96, 5. It is therefore essential that the conditions for deprivation of liberty under domestic law be clearly defined and that the law itself be foreseeable in its application, so that it meets the standard of "lawfulness" set by the Convention, a standard which requires that all law be sufficiently accessible and precise to allow the person - if necessary with appropriate advice - to foresee, to a degree that is reasonable in the circumstances, the consequences a given action may entail (see, for example, Varbanov v.
