  • EGMR, 27.06.1968 - 1936/63

    Neumeister ./. Österreich

    Auszug aus EGMR, 25.04.2000 - 31315/96
Having considered the particular circumstances of the case, the Court finds that neither the repeated refusal of release on bail nor the eventual imposition of a security of CZK 30, 000,000, given the scale of the applicant's financial transactions, infringed the applicant's rights under Article 5 § 3 (see, in contrast, the Neumeister v. Austria judgment of 27 June 1968, Series A no. 8, p. 40, § 14).
  • EGMR, 10.11.1969 - 1602/62

    Stögmüller ./. Österreich

    Auszug aus EGMR, 25.04.2000 - 31315/96
The Court reiterates that the "reasonable time" requirement set out in Article 6 § 1 and that contained in Article 5 § 3 are to be distinguished from each other (see the Stögmüller v. Austria judgment of 10 November 1969, Series A no. 9, p. 40, § 5).
  • EGMR, 16.12.1992 - 12129/86

    HENNINGS v. GERMANY

    Auszug aus EGMR, 25.04.2000 - 31315/96
Where such grounds were "relevant" and "sufficient", the Court must also ascertain whether the competent national authorities displayed "special diligence" in the conduct of the proceedings (see, among other authorities, the Assenov v. Bulgaria judgment of 28 October 1998, Reports of Judgments and Decisions 1998-VIII, p. 3300, § 154, and the W. v. Switzerland judgment of 26 January 1993, Series A no. 251-A, p. 15, § 30).
  • EGMR, 28.03.1990 - 11968/86

    B. ./. Österreich

    Auszug aus EGMR, 25.04.2000 - 31315/96
It may also examine the applicant's detention on remand between 15 March 1995 and 16 January 1996, that is to say from the moment when the Court of Cassation quashed the first judgment delivered by the City Court until the latter delivered its second judgment (see the B. v. Austria judgment of 28 March 1990, Series A no. 175, pp. 15-16, § 39).

    JECIUS v. LITHUANIA

La Cour doit alors établir si les autres motifs retenus par les autorités judiciaires sont « pertinents'et « suffisants'pour continuer à légitimer la privation de liberté (voir, notamment, l'arrêt Punzelt c. République tchèque, no 31315/96, § 73, 25 avril 2000, non publié).
  • EGMR, 26.07.2001 - 33977/96

    ILIJKOV v. BULGARIA

Having regard to its case-law (see the Lukanov v. Bulgaria judgment of 10 March 1997, Reports 1997-II, § 56; the Assenov and Others v. Bulgaria judgment of 28 October 1998; Reports 1998-VIII, §§ 176-178; Nikolova v. Bulgaria [GC], no. 31195/96, § 79, ECHR 1999-II; Jecius v. Lithuania, loc. cit., § 109; Punzelt v. the Czech Republic, no. 31315/96, 25 April 2000, unreported; Grauslys v. Lithuania, loc. cit.; Musial v. Poland, 24557/94, ECHR 1999-II; Sabeur Ben Ali v. Malta, no. 35892/97; and Varbanov v. Bulgaria, no. 31365/98, § 67, ECHR 2000-X), and ruling on an equitable basis, the Court awards the global sum of BGN 6, 000 under the head of non-pecuniary damage in respect of the violations of the Convention found in the present case.

    NIKOLOV v. BULGARIA

cit., § 109; Punzelt v. the Czech Republic, no. 31315/96, 25 April 2000, unreported; Grauslys v. Lithuania, loc.
  • EGMR, 21.06.2005 - 67030/01

    MELLO v. SLOVAKIA

    (b) The Court further finds that the remaining issues raised by the first applicant in reliance on Article 5 of the Convention in respect of his continued detention on remand and, in particular, its length fall to be examined under paragraph 3 of that Article (see, mutatis mutandis, Scott v. Spain, no. 21335/93, § 61, ECHR 1996-VI and Punzelt v. the Czech Republic (dec.), no. 31315/96, 4 May 1999).
