Verfahrensaussetzung - Vorgreiflichkeit - Beschleunigungsgrundsatz
Es beruft sich dazu auf die Aussetzungsentscheidungen des Bundesarbeitsgerichts vom 28. Juni 2021 (4 AZR 324/20 (A)) und des Landesarbeitsgerichts Sachsen-Anhalt vom 13. Juli 2021 (5 Sa 350/20 E) sowie zuletzt auf die Entscheidung des Bundesarbeitsgerichts vom 20. Dezember 2021 im Rechtsbeschwerdeverfahren 9 AZB 32/21.Voraussetzung ist aber in jedem Fall zunächst die klare, unmissverständliche Erklärung, dass die Klage schlüssig ist (vgl. zu einer solchen kurzen Feststellung: BAG 20. Dezember 2021 - 9 AZB 32/21) .
(8) Entgegen der Auffassung des beklagten Landes folgt auch aus der Entscheidung des Bundesarbeitsgerichts vom 20. Dezember 2021 im Rechtsbeschwerdeverfahren 9 AZB 32/21 nichts anderes.
Es liegt aus den dargestellten Gründen insbesondere auch keine Divergenz zu der Entscheidung des Bundesarbeitsgerichts vom 20. Dezember 2021 (9 AZB 32/21) vor.
