  Relying on Article 18 of the Constitution which prohibits discrimination (see paragraph 17 below) and the Court's judgment in the case of Lavida and Others v. Greece (no. 7973/10, 30 May 2013), the Commissioner found that the placement of Roma pupils in a special school segregates them and does not allow for their integration into mainstream social activities.

  Similarly, the government did not explain why the desegregation measures which all parties considered to be necessary would have been implemented more effectively if ordered by a court judgment compared to an independent administrative authority such as the Commissioner (see, mutatis mutandis, Lavida and Others v.
