Um den Richtern, die die Rechtssache übernehmen, umfassende Kenntnis von deren Einzelheiten und dem Vortrag zu verschaffen, können Maßnahmen getroffen werden, wie etwa die Übermittlung von Protokollen, wenn die Glaubwürdigkeit des fraglichen Zeugen außer Frage steht, oder die Ansetzung neuer Schlussplädoyers oder aber eine erneute Vernehmung wichtiger Zeugen vor dem umbesetzten Gericht (EGMR, 2. En faisant une lecture combinée des arrêts Mischie c. Roumanie (no 50224/07, 16 septembre 2014) et Cutean c. Roumanie (no 53150/12, 2 décembre 2014), il soutenait que son droit à un procès équitable serait méconnu dans l'hypothèse où l'arrêt rendu en appel serait prononcé par une formation de jugement différente de celle qui avait entendu les témoins.Toutefois, le principe d'immédiateté ne saurait être regardé comme faisant obstacle à tout changement dans la composition d'un tribunal pendant le déroulement d'un procès (Cutean c. Roumanie, no 53150/12, § 61, 2 décembre 2014).

ALPPI v. FINLAND
The Court is satisfied that the use of video link served a legitimate aim, namely to reduce the spread of COVID-19. As to the requirement for due process, the Court finds it important that in the circumstances of the applicant's case, even if the use of video link had an impact on the immediacy of the trial in technical terms, as accepted by the Supreme Court, the case was not one that could have given rise to concerns that the judges adjudicating the case had not themselves taken the important evidence (see for example, mutatis mutandis, Graviano v. Italy, no. 10075/02, §§ 39-40, 10 February 2005, and Skaro v. Croatia, no. 6962/13, §§ 22-31, 6 December 2016 (in both of which no violations of the Convention were found), and also Cutean v.
