CENTRE FOR LEGAL RESOURCES ON BEHALF OF VALENTIN CÂMPEANU v. ROMANIA
Auszug aus EGMR, 19.02.2019 - 72681/10
Where the applicant has died after the application was lodged, the Court has accepted that the next of kin or heir may in principle pursue the application, provided that he or she has sufficient interest in the case (see Centre for Legal Resources on behalf of Valentin Câmpeanu v. Romania [GC], no. 47848/08, § 97, ECHR 2014, with further references). - EGMR, 25.03.1999 - 25444/94
PÉLISSIER AND SASSI v. FRANCE
Auszug aus EGMR, 19.02.2019 - 72681/10
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities, and what was at stake for the applicant in the dispute (see, among many other authorities, Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II, and Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII). - EGMR, 27.06.2000 - 30979/96
FRYDLENDER c. FRANCE
Auszug aus EGMR, 19.02.2019 - 72681/10

VAN OOSTERWIJCK c. BELGIQUE
Auszug aus EGMR, 19.02.2019 - 72681/10
As shown by the Court's practice, that omission did not prevent separate opinions from being joined to "judgments" which dealt exclusively with inadmissibility issues during the Commission period (see Van Oosterwijck v. Belgium, 6 November 1980, Series A no. 40, and Cardot v. France, no. 11069/84, 19 March 1991). - EGMR, 31.03.2016 - 55287/10
SETON v. THE UNITED KINGDOM
Auszug aus EGMR, 19.02.2019 - 72681/10
Restatement of those principles can be found in, for example, Seton v. the United Kingdom, no. 55287/10, §§ 57-59, 31 March 2016, and Boyets v. Ukraine, no. 20963/08, §§ 74-76, 30 January 2018). - EGMR, 19.01.2017 - 60041/13
SINGH ET AUTRES c. GRÈCE
Auszug aus EGMR, 19.02.2019 - 72681/10
In such cases, the decisive point is not whether the rights in question are or are not transferable to the heirs wishing to pursue the procedure, but whether the heirs can in principle claim a legitimate interest in asking the Court to deal with the case on the basis of the applicant's wish to exercise his or her individual and personal right to lodge an application with the Court (see Singh and Others v. Greece, no. 60041/13, § 26, 19 January 2017). - EGMR, 30.01.2018 - 20963/08
BOYETS v. UKRAINE

TERRONE c. ITALIE
- EGMR, 22.04.2021 - 57255/10
KALANDIA v. GEORGIA
Having regard to the circumstances of the present case, the Court accepts that the applicant's son has a legitimate interest in pursuing the application, in so far as it has been lodged by the applicant (see Singh and Others v. Greece, no. 60041/13, § 26, 19 January 2017, and Garbuz v. Ukraine, no. 72681/10, § 28, 19 February 2019).
