W. c. SUISSE
Auszug aus EGMR, 17.02.2005 - 56271/00
They referred, on this point, to the findings of the Court in the cases of Stögmüller, Wemhoff and W. v. Switzerland, where delays similar to those imputable to the Italian authorities had not been considered excessive (see Stögmüller v. Austria, judgment of 10 November 1969, Series A no. 9; Wemhoff v. Germany, judgment of 27 June 1968, Series A no. 7; W. v. Switzerland, judgment of 26 January 1993, Series A no. 254-A).Continued detention can be justified in a given case only if there are specific indications of a genuine requirement of public interest which, notwithstanding the presumption of innocence, outweighs the rule of respect for individual liberty (see, among other authorities, W. v. Switzerland, judgment of 26 January 1993, Series A no. 254-A, p. 15, § 30, and Pantano v. Italy, no. 60851/00, § 66, 6 November 2003).

TOMASI c. FRANCE
Auszug aus EGMR, 17.02.2005 - 56271/00
However, the existence of a strong suspicion of the involvement of a person in serious offences, while constituting a relevant factor, cannot alone justify a long period of pre-trial detention (see Tomasi v. France, judgment of 27 August 1992, Series A no. 241-A, p. 35, § 89, and Scott v. Spain, judgment quoted above, p. 2401, § 78). - EGMR, 15.07.1982 - 8130/78
Eckle ./. Deutschland
Auszug aus EGMR, 17.02.2005 - 56271/00
The Court first notes that in their comments on the applicant's claims for just satisfaction, the Government acknowledged that the deduction of the time spent in custody from the sentence does not deprive a person of the quality of victim under Article 5 § 3. Even assuming that this statement should not be interpreted as an implicit withdrawal of the Government's objection, the Court recalls that an individual can no longer claim to be a victim of a violation of the Convention when the national authorities have acknowledged, either expressly or in substance, the breach of the Convention and afforded redress (Eckle v. Germany, judgment of 15 July 1982, Series A no. 51, p. 30, § 66. For the application of this principle in the context of Article 6, see Lüdi v. Switzerland, judgment of 15 June 1992, Series A no. 238, p. 18, § 34 and Schlader v. Austria (Dec.), no. 31093/96, 7 March 2000).

LÜDI v. SWITZERLAND
CLOOTH v. BELGIUM
Auszug aus EGMR, 17.02.2005 - 56271/00
Referring to the Court's approach in the case of Clooth v. Belgium (see judgment of 12 December 1991, Series A no. 225, p. 14, § 35), the Government considered that the period to be taken into consideration under Article 5 § 3 should end on the day on which the first order for detention with a view to extradition was issued (15 May 1998). - EGMR, 30.01.2003 - 40877/98
CORDOVA c. ITALIE (N° 1)
Auszug aus EGMR, 17.02.2005 - 56271/00
The Court notes that, although Article 35 § 4 of the Convention allows it to reject an application that it finds inadmissible under Article 35 at any stage in the proceedings, it has held that only new information and exceptional circumstances would induce it to reconsider its dismissal of an objection which was lodged and considered at the admissibility stage (see Cisse v. France, no. 51346/99, § 32, ECHR 2002-III, and Cordova v. Italy (No. 1), no. 40877/98, § 31, CEDH 2003-I). - EGMR, 22.06.1972 - 2614/65
RINGEISEN v. AUSTRIA (ARTICLE 50)
Auszug aus EGMR, 17.02.2005 - 56271/00
Moreover, it should be recalled that the fact of deducting the time spent in detention on remand from the prison sentence imposed on a person does not in any way acquire the character of restitutio in integrum, for no freedom is given in place of the freedom unlawfully taken away (see Ringeisen v. Austria, judgment (article 50) of 22 June 1972, Series A no. 15, p. 8, § 21).

Espagne (déc.), no 53652/00, 21 novembre 2000, Peñafiel Salgado c. Espagne (déc.), no 65964/01, 16 avril 2002, Sardinas Albo c. Italie (déc.), no 56271/00, CEDH 2004-I, Cipriani c. Italie (déc.), no 22142/07, 30 mars 2010, et Schuchter, décision précitée). - EGMR, 01.03.2006 - 56581/00
SEJDOVIC c. ITALIE
Italie (déc.), no 56271/00, CEDH 2004-I, et Brusco c. Italie (déc.), no 69789/01, CEDH 2001-IX). - EGMR, 27.01.2009 - 67021/01
Italie, no 56271/00, § 110, 17 février 2005).

GIACOMELLI c. ITALIE
Italie, no 56271/00, § 110, 17 février 2005). - EGMR, 27.02.2014 - 35/10

RIZZOTTO c. ITALIE (N° 2)
Italie (déc.), no 56271/00, 8 janvier 2004). - EGMR, 25.02.2014 - 41444/09

BRUSCO v. ITALY
Auszug aus EGMR, 08.01.2004 - 56271/00
The provisions of this law are described in Brusco v. Italy (dec.), no. 69789/01, 6 September 2001, ECHR 2001-IX.Moreover, it is now clear that, given the wording of the Act and the background to its adoption, the remedy in question must be exhausted also by those persons who introduced their claims in Strasbourg before the date of its entry into force (see, amongst other authorities, Brusco v. Italy (dec.), no. 69789/01, 6 September 2001, ECHR 2001-IX).

ASCH v. AUSTRIA
Auszug aus EGMR, 08.01.2004 - 56271/00
The Court must ascertain whether the proceedings as a whole were fair (Van Mechelen and others v. the Netherlands, judgment of 23 April 1997, Reports 1997-III, p. 711, § 50, and Asch v. Austria, judgment of 26 April 1991, Series A no. 203, p. 10, § 26). - EGMR, 21.01.1999 - 30544/96
GARCÍA RUIZ v. SPAIN
Auszug aus EGMR, 08.01.2004 - 56271/00
It is primarily for the national authorities, notably the courts, to establish the facts and resolve problems of interpretation of domestic legislation (see, among others authorities, García Ruiz v. Spain [GC], no. 30544/96, CEDH 1999-I, § 28).

HENTRICH v. FRANCE
Auszug aus EGMR, 08.01.2004 - 56271/00
The purpose of Article 35 is to afford the Contracting States the opportunity of preventing or putting right the violations alleged against them before those allegations are submitted to the Court (see, for example, Hentrich v. France, judgment of 22 September 1994, Series A no. 296-A, p. 18, § 33, and Remli v. France, judgment of 23 April 1996, Reports of Judgments and Decisions 1996-II, p. 571, § 33). - EGMR, 06.11.1980 - 7654/76
VAN OOSTERWIJCK c. BELGIQUE
Auszug aus EGMR, 08.01.2004 - 56271/00
However, the existence of mere doubts as to the prospects of success of a particular remedy which is not obviously futile is not a valid reason for failing to exhaust domestic remedies (see Akdivar v. Turkey, judgment of 16 September 1996, Reports 1996-IV, p. 1212, § 71, and Van Oosterwijck v. Belgium, judgment of 6 November 1980, Series A no. 40, p. 18, § 37). - EGMR, 28.03.1990 - 11968/86

After the date of the Como District Court's judgment, the applicant's deprivation of liberty was based on Article 5 § 1 (a) of the Convention as "the lawful detention of a person after conviction by a competent court" and cannot therefore be taken into account for the purposes of Article 5 § 3 of the Convention (see, for instance, B. v. Austria, judgment of 28 March 1990, Series A no. 175, p. 14, § 36).
