In addition, even assuming that the applicant was subjected to threats and/or verbal abuse as alleged, and as a result he felt apprehension or disquiet, the Court recalls that such feelings are not sufficient to amount to degrading treatment, within the meaning of Article 3 (see, in particular, Hüsniye Tekin v. Turkey, no. 50971/99, § 48, 25 October 2005 and mutatis mutandis, Campbell and Cosans v. the United Kingdom, judgment of 25 February 1982, Series A no. 48, §§ 27 and 28).

    Auszug aus EGMR, 10.10.2006 - 57406/00
A description of the relevant domestic law at the material time can be found in Batı and others v. Turkey (nos. 33097/96 and 57834/00, §§ 96-100, 3 June 2004).

    ANDREYEVSKIY v. RUSSIA

Turning to the particular circumstances of the case, the Court considers that the applicant's description of the alleged ill-treatment accompanied by the medical certificate of 21 May 2002 may be regarded as raising a reasonable suspicion that his injuries had been caused during his detention after arrest (compare Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).

In addition, even if the applicant was subjected to threats and/or verbal abuse as alleged, and as a result he felt apprehension or disquiet, the Court reiterates that such feelings are not sufficient to amount to degrading treatment within the meaning of Article 3 (see, in particular, Hüsniye Tekin v. Turkey, no. 50971/99, § 48, 25 October 2005, and Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).

  • EGMR, 17.07.2008 - 28433/02

    CAMDERELI v. TURKEY

At the outset the Court notes that some of the applicant's references to the alleged ill-treatment could be construed as also including the verbal abuse she had allegedly received from Mr M.A.G. and Mr M.G. However, the Court notes that, even assuming that this is the case, and even if the applicant was subjected to threats and/or verbal abuse as alleged and that, as a result, she felt apprehension or disquiet, the Court reiterates that such feelings are not sufficient to amount to degrading treatment, within the meaning of Article 3 (see, in particular, Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).

    AYAN c. TURQUIE

Contrairement à ce qui est sous-entendu dans l'évaluation médicale produite plus de huit ans et demi après les faits (paragraphe 29 in fine ci-dessus) - soit trop tardivement pour être probante (Olszewski c. Pologne (déc.), no 55264/00, 13 novembre 2003 ; Dursun Çevik c.

    SHARKUNOV AND MEZENTSEV v. RUSSIA

Nor is it apparent from the material in the case file before the Court that after that date the applicant amended his mother's statement to make it more detailed and consistent (see paragraphs 12, 20 and 45 above; see also Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).
  • EGMR, 28.04.2009 - 5387/02

    KELEKÇIER c. TURQUIE

Ce rapport médical, qui a été établi trois jours après les faits dénoncés par le requérant, ne permet pas de situer avec certitude dans le temps les blessures qui y sont mentionnées (voir, en ce sens, Dursun Çevik c. Turquie (déc.), no 57406/00, 10 octobre 2006).
  • EGMR, 03.06.2008 - 32577/02

    ORHAN KUR v. TURKEY

In light of the above and in the absence of a plausible explanation from the Government as to the cause of the injuries sustained by the applicant, the Court finds it established beyond reasonable doubt that the applicant was taken to the Balçova police station on the night of 28 July 1997 and subjected to falaka (see, a contrario, Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).
  • EGMR, 11.12.2007 - 71795/01

    K.Ö. v. TURKEY

In addition, as regards the second incident on 28 November 1999, even assuming that there was some factual basis to the applicant's claims, leaving her with feelings of apprehension or disquiet, the Court recalls that such feelings would not be enough in themselves to amount to degrading treatment within the meaning of Article 3 (see, in particular, Hüsniye Tekin v. Turkey, no. 50971/99, § 48, 25 October 2005, and Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).
  • EGMR, 08.07.2014 - 59177/10

    YERLI v. TURKEY

In light of the above, the Court considers that the applicant brought to the attention of the national authorities an arguable claim which obliged those authorities to carry out an effective investigation as required by Article 3 of the Convention (see Dursun Çevik v. Turkey (dec.), no. 57406/00, 10 October 2006).
