O'ROURKE v. THE UNITED KINGDOM
Art. 3, Art. 8, Art. 8 Abs. 1, Art. 13 MRK
Inadmissible (englisch)

- EGMR, 24.11.1986 - 9063/80
Auszug aus EGMR, 26.06.2001 - 39022/97
The Court recalls further that an individual must show sufficient and continuing links with a place in order that he can establish that it is his "home" for the purposes of Article 8 (see Gillow v. the United Kingdom, judgment of 24 November 1996, Series A no. 109, § 46). - EGMR, 27.04.1988 - 9659/82
Auszug aus EGMR, 26.06.2001 - 39022/97
According to the Court's case-law, Article 13 applies only where an individual has an "arguable claim" to be the victim of a violation of a Convention right (see the Boyle and Rice v. the United Kingdom judgment of 27 April 1988, Series A no. 131, § 52). - EGMR, 04.05.1999 - 36448/97
MARZARI v. ITALY
Auszug aus EGMR, 26.06.2001 - 39022/97
Thus, for example, in the case of Marzari v. Italy (application no. 36448/97, decision of 4 May 1999, unpublished) the Court stated that a refusal by the authorities to provide housing assistance to an individual suffering from a serious disease might in certain circumstances raise an issue under Article 8 because of the impact of such refusal on the private life of the individual.

FEDERATION NATIONALE DES SYNDICATS SPORTIFS (FNASS) ET AUTRES c. FRANCE
La Cour n'a pas exclu qu'une loge d'artiste ou une chambre d'hotel puissent être assimilées à un «domicile'(Hartung c. France (déc.), no 10231/07, 3 novembre 2009 et O'Rourke c. Royaume-Uni (déc.), no 39022/97, 26 juin 2001). - EGMR, 18.06.2009 - 45603/05
BUDINA v. RUSSIA
The Court cannot exclude that State responsibility could arise for "treatment" where an applicant, in circumstances wholly dependent on State support, found herself faced with official indifference when in a situation of serious deprivation or want incompatible with human dignity (see O'Rourke v. United Kingdom, no. 39022/97, 26 June 2001, where the Court held that the applicant's suffering, notwithstanding that he had remained on the streets for 14 months to the detriment of his health, had not attained the requisite level of severity to engage Article 3 and had, in any event, not been the result of State action rather than his own volition as he had been eligible for public support but had been unwilling to accept temporary accommodation and had refused two offers of permanent accommodation; also see, mutatis mutandis, Nitecki v. Poland, no. 65653/01, 21 March 2002, where, in rejecting the applicant's complaint about the State's refusal to refund him the full price of a life-saving drug, the Court noted while Article 2 might be engaged if the authorities of a Contracting State put an individual's life at risk through the denial of health care which they have undertaken to make available to the population generally, in this case 70% of the drug price had been compensated by the State and the applicant only had to stand for the outstanding 30%). - EGMR, 10.09.2020 - 63141/13
GJUTAJ ET AUTRES c. FRANCE
Royaume-Uni (dec.), no 39022/97, CEDH 26 juin 2001).
- EGMR, 24.04.2012 - 25446/06
YORDANOVA AND OTHERS v. BULGARIA
Article 8 does not in terms give a right to be provided with a home (see, Chapman, cited above, § 99) and, accordingly, any positive obligation to house the homeless must be limited (see O'Rourke v. the United Kingdom (dec.), no. 39022/97, ECHR 26 June 2001). - EGMR, 02.12.2014 - 14217/10
STRZELECKA v. POLAND
The Court has also held that the scope of any positive obligation to house the homeless must be limited (see Costache v Romania (dec), no. 25615/07, 23 July 2012, § 21 and O'Rourke v. the United Kingdom (dec.), no. 39022/97).). - EGMR, 17.11.2022 - 45871/16

Royaume-Uni (déc.), no 39022/97, CEDH 26 juin 2001). - EGMR, 17.11.2022 - 41969/16
