- EGMR, 13.06.1979 - 6833/74
Auszug aus EGMR, 19.07.2007 - 43151/04
In this connection, the Court observes that by guaranteeing the right to respect for family life, Article 8 of the Convention presupposes the existence of a family (see, amongst other authorities, Marckx v. Belgium, judgment of 13 June 1979, Series A no. 31, p. 14, § 31). - EGMR, 27.06.2000 - 30979/96
Auszug aus EGMR, 19.07.2007 - 43151/04
The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII). - EGMR, 18.12.1987 - 11329/85
Auszug aus EGMR, 19.07.2007 - 43151/04
The Court notes that if national legislation allows divorce, which is not a requirement of the Convention, Article 12 secures for divorced persons the right to remarry without unreasonable restrictions (see F. v. Switzerland, judgment of 18 December 1987, Series A no. 128, p. 18, § 38). - EGMR, 06.05.1981 - 7759/77
Buchholz ./. Deutschland
Auszug aus EGMR, 19.07.2007 - 43151/04
The Court reiterates that failure to try an action within a reasonable time can on occasions have repercussions as regards respect for some other right guaranteed by the Convention (see, inter alia, Buchholz v. Germany, judgment of 6 May 1981, Series A no. 42, p. 22, § 65). - EGMR, 15.07.2003 - 44978/98
BERLIN c. LUXEMBOURG
Auszug aus EGMR, 19.07.2007 - 43151/04
However, the applicant does not make any reference to an existing family for which he could claim the right to respect under this provision (see for example, Berlin v. Luxembourg, no. 44978/98, § 64, 15 July 2003).
- EGMR, 23.01.2025 - 13805/21
H.W. ./. Frankreich - Fehlender Sex begründet keine Schuld an Scheidung
Bulgarie (déc.), no 15001/04, § 61, 14 juin 2011, et Babiarz, précité, § 50 ; voir, également, F. c. Suisse, 18 décembre 1987, § 38, série A no 128, et Aresti Charalambous c. Chypre (déc.), no 43151/04, § 56, 19 juillet 2007). - EGMR, 10.01.2017 - 1955/10
Ein Recht auf Scheidung? Pole scheitert mit Scheidungswunsch
50. Thus, the Court has not ruled out that the unreasonable length of judicial divorce proceedings could raise an issue under Article 12 (see Aresti Charalambous v. Cyprus, no. 43151/04, § 56, 19 July 2007).After eleven years of cohabitation and with a child of similar age, such argument even goes against the idea that an unreasonable length of judicial divorce proceedings could raise an issue under Article 12 (see paragraph 50, citing Aresti Charalambous v. Cyprus, no. 43151/04, § 56, 19 July 2007).
- EGMR, 17.11.2022 - 34812/15
MAKRYLAKIS c. GRÈCE
Lastly, special consideration must be given in the instant case to the nature of the allegations which were pending against the applicant, the criminal nature of the proceedings and the diligence required in such cases (see, mutatis mutandis, Aresti Charalambous v. Cyprus, no. 43151/04, §§ 45-47, 19 July 2007).
- EGMR, 22.11.2016 - 8923/12
PIOTROWSKI v. POLAND
Thus, the Court has not ruled out that the unreasonable length of judicial divorce proceedings could raise an issue under Article 12 (see Aresti Charalambous v. Cyprus, no. 43151/04, § 56, 19 July 2007). - EGMR, 29.01.2008 - 42402/05
WILDGRUBER v. GERMANY
Assuming the exhaustion of domestic remedies, it reiterates that if national legislation allows divorce, which is not a requirement of the Convention, Article 12 secures for divorced persons the right to remarry without unreasonable restrictions (see F. v. Switzerland, judgment of 18 December 1987, Series A no. 128, p. 18, § 38, and Aresti Charalambous v. Cyprus, no. 43151/04, § 56, 19 July 2007). - EGMR, 06.12.2011 - 16192/06
[FRE]
Quant au respect de la vie familiale, force est de constater que le requérant ne fait nullement allusion à une famille existante au sujet de laquelle il pourrait revendiquer le droit au respect de la vie familiale au titre de l'article 8 (Aresti Charalambous c. Chypre, no 43151/04, § 51, 19 juillet 2007, et Berlin c. Luxembourg, no 44978/98, § 64, 15 juillet 2003 ; Bacuzzi c. Italie (déc.), no 43817/04, 24 mai 2011). - EGMR, 09.04.2024 - 49512/22
ALEXANDROU v. CYPRUS
This delay has not been explained and appears to be unjustified, particularly considering the nature of the allegations which were pending against the applicant, the criminal nature of the proceedings and the diligence required in such cases (see, Aresti Charalambous v. Cyprus, no. 43151/04, § 45-47, 19 July 2007). - EGMR, 11.09.2013 - 62242/00
GREGORIOU ET 24 AUTRES AFFAIRES CONTRE CHYPRE
43151/04. - EGMR, 21.03.2024 - 1949/22
LEONIDOU v. CYPRUS
The Court has established clear and extensive case-law concerning complaints relating to the excessive length of criminal proceedings (see, for example, Aresti Charalambous v. Cyprus, no. 43151/04, § 44-47, 19 July 2007, and Pélissier and Sassi v. France [GC], no. 25444/94, § 67, ECHR 1999-II). - EGMR, 14.06.2011 - 15001/04
[FRE]
Dans une série d'arrêts et décisions plus récents, la Cour n'a pas exclu que la durée excessive d'une procédure de divorce puisse poser un problème sous l'angle de cette disposition de la Convention (Aresti Charalambous c. Chypre, no 43151/04, § 56, 19 juillet 2007, et Wildgruber c. Allemagne (déc.), nos 42402/05 et 42423/05, 29 janvier 2008). - EGMR, 17.01.2008 - 21674/05
