RAFFINERIES GRECQUES STRAN ET STRATIS ANDREADIS c.

Grèce, 9 décembre 1994, série A no 301-B, p. 84, § 59).

Under Article 1 of the First Protocol, in reliance on the judgment in Stran Greek Refineries and Stratis Andreadis v. Greece, 9 December 1994, § 59, Series A no. 301-B, the majority identify the relevant "possession" for the purposes of Article 1 of the First Protocol as being the judgment debt arising as a result of the judgment of the Florence Court of Appeal.

    SHARXHI AND OTHERS v. ALBANIA

Albanie, no 10613/16, § 93, 11 janvier 2018).

In § 52 of the judgment, the majority recall the Court's consistent jurisprudence that a person who has obtained a judgment against the State at the end of legal proceedings should not be expected to bring separate enforcement proceedings (see e.g. Metaxas v. Greece, no. 8415/02, § 19, 27 May 2004, Burdov v. Russia (no. 2), no. 33509/04, § 68, ECHR 2009 and Sharxhi and Others v. Albania, no. 10613/16, § 93, 11 January 2018).

  • EGMR, 18.06.2002 - 48757/99

    SHESTAKOV v. RUSSIA

Once the enforcement procedures were closed by a court in accordance with the national legislation, the responsibility of the State ended (Shestakov v. Russia (dec), no. 48757/99, 18 June 2002).

  • EGMR, 20.11.1995 - 17849/91
    Auszug aus EGMR, 14.03.2019 - 43422/07
In this connection, the taking of property without payment of an amount reasonably related to its value will normally constitute a disproportionate interference and a total lack of compensation can be considered justifiable under Article 1 of the First Protocol only in exceptional circumstances (The Holy Monasteries v. Greece, judgment of 9 December 1994, Series A no. 301-A, pp. 34-35, §§ 70-71; Pressos Compania Naviera S.A. and Others v. Belgium, judgment of 20 November 1995, Series A no. 332, p. 23, § 38; and Pincová and Pinc v. the Czech Republic, no. 36548/97, § 52, ECHR 2002-VIII).

    FUKLEV v. UKRAINE

    Auszug aus EGMR, 14.03.2019 - 43422/07
In this latter context, the Court has consistently held that State responsibility for the enforcement of a judgment against a private company extends no further than the involvement of State bodies in the enforcement procedures (Fuklev v. Ukraine, no. 71186/01, § 67 and §§ 90-11, 7 June 2005 and Ciocodeică v. Romania, no. 27413/09, § 85, 16 January 2018).
  • EGMR, 27.05.2003 - 50342/99

    SANGLIER c. FRANCE

    Auszug aus EGMR, 14.03.2019 - 43422/07
Furthermore and of particular importance in the present case, the Court has further confirmed that where the debtor is a private individual, the responsibility of the State cannot be engaged on account of non-payment of an enforceable debt as a result of the insolvency of that "private" debtor (Sanglier v. France, no. 50342/99, § 39, 27 May 2003; Ciprová v. the Czech Republic (dec.), no. 33273/03, 22 March 2005; Cubanit v. Romania (dec.), no. 31510/02, 4 January 2007; and Bozza v. Italy, cited above).

    METAXAS c. GRECE

    Auszug aus EGMR, 14.03.2019 - 43422/07
In § 52 of the judgment, the majority recall the Court's consistent jurisprudence that a person who has obtained a judgment against the State at the end of legal proceedings should not be expected to bring separate enforcement proceedings (see e.g. Metaxas v. Greece, no. 8415/02, § 19, 27 May 2004, Burdov v. Russia (no. 2), no. 33509/04, § 68, ECHR 2009 and Sharxhi and Others v. Albania, no. 10613/16, § 93, 11 January 2018).

    AKASHEV v. RUSSIA

    Auszug aus EGMR, 14.03.2019 - 43422/07
In the context of enforcement of judgments against the State, the Court's case law, of course, also confirms that the requirement of the creditor's cooperation must not go beyond what is strictly necessary and, in any event, does not relieve the authorities of their obligation under the Convention to take timely action of their own motion, on the basis of the information available to them, with a view to honouring the judgment against the State (see Akashev v. Russia, no. 30616/05, § 22, 12 June 2008).

    CIOCODEICA v. ROMANIA

Italie, no 43422/07, §§ 41-42 et 52, 14 mars 2019) ?.

    TURHAN AND KORKMAZ v. TURKEY
