MAESTRI c. ITALIE
Auszug aus EGMR, 18.11.2004 - 54268/00
It follows, inter alia, that a judgment in which the Court finds a violation of the Convention or its Protocols imposes on the respondent State a legal obligation not just to pay those concerned the sums awarded by way of just satisfaction, but also to choose, subject to supervision by the Committee of Ministers of the Council of Europe, the general and/or, if appropriate, individual measures to be adopted in its domestic legal order to put an end to the violation found by the Court and make all feasible reparation for its consequences in such a way as to restore as far as possible the situation existing before the breach (see, mutatis mutandis, Maestri v. Italy [GC], no. 39748/98, § 47, 17 February 2004; Mentes and Others v. Turkey (Article 50), judgment of 24 July 1998, Reports 1998-IV, p. 1695, § 24; and Scozzari and Giunta v. Italy [GC], nos.

NEJDET SAHIN AND PERIHAN SAHIN c. TURQUIE
Albanie (déc.), no 54268/00, CEDH 2003-XI).

AKSOY c. TURQUIE
Auszug aus EGMR, 02.10.2003 - 54268/00
Article 35 § 1 also requires that the complaints intended to be brought subsequently before the Court should have been made to the appropriate domestic body, at least in substance and in compliance with the formal requirements laid down in domestic law, but not that recourse should be had to remedies which are inadequate or ineffective (see Aksoy v. Turkey, no. 21987/93, §§ 51-52, ECHR 1996-VI, and Akdivar and Others v. Turkey, no. 21893/93, §§ 65-67, ECHR 1996-IV).
