Denisov v. Ukraine
Auszug aus EGMR, 20.10.2020 - 57860/14
Lastly, the result of the proceedings must be directly decisive for the "civil" right in question, mere tenuous connections or remote consequences not being sufficient to bring Article 6 § 1 into play (see Denisov v. Ukraine [GC], no. 76639/11, § 44, 25 September 2018; Regner v. the Czech Republic [GC], no. 35289/11, § 99, 19 September 2017; Károly Nagy v. Hungary [GC], no. 56665/09, § 60, 14 September 2017; Naït-Liman v. Switzerland [GC], no. 51357/07, § 106, 15 March 2018). - EGMR, 20.03.2018 - 37685/10
RADOMILJA AND OTHERS v. CROATIA
Auszug aus EGMR, 20.10.2020 - 57860/14
Being master of the characterisation to be given in law to the facts of the case (see Radomilja and Others v. Croatia [GC], nos. 37685/10 and 22768/12, § 114, 20 March 2018), the Court considers that these complaints are closely linked and fall to be examined solely under Article 10 of the Convention, which reads as follows:.
- EGMR, 25.03.2021 - 1864/18
MATALAS v. GREECE
In this regard, the Court notes that even private documents disseminated to a restricted number of persons need to have some factual basis (see Bilan v. Croatia (dec.), no. 57860/14, § 37, 20 October 2020). - EGMR, 18.01.2024 - 20725/20
ALLEE c. FRANCE
Portugal, no 4035/08, § 38, 11 janvier 2011). - EGMR, 17.06.2025 - 5605/21
GA? PARINI v. CROATIA
Rn. 20 While the Court accepted that judicial review may be entirely excluded for some minor breaches of an association's statute or internal regulations (see, for example, Bilan v. Croatia (dec.), no. 57860/14, §§ 29-31, 20 October 2020, where the measure imposed on the applicant was not of a disciplinary nature and did not affect her rights and obligations stemming from her membership in an association), the disciplinary measure imposed on the applicant in the present case deprived him of the right to hunt for a period of two years. - EGMR, 11.04.2023 - 35726/20
INAN v. TÜRKIYE
The Court therefore considers that it may leave open the issue of applicability of Article 6 § 1 in the present case because, even assuming that that provision was applicable ratione materiae to the dispute in question, there will be no lack of access to court within the meaning of Article 6 of the Convention when a restriction such as the one mentioned above pursues a legitimate aim and there is a reasonable relationship of proportionality between the means employed and the aim sought to be achieved (see, for example, Bilan v. Croatia (dec.), no. 57860/14, § 27, 20 October 2020).
