  • EGMR, 07.12.1976 - 5493/72

    HANDYSIDE v. THE UNITED KINGDOM

    Auszug aus EGMR, 29.03.2005 - 72713/01
Such are the demands of that pluralism, tolerance and broadmindedness without which there is no "democratic society" (see Handyside v. the United Kingdom, judgment of 7 December 1976, Series A no. 24, p. 23, § 49).

The Court reiterates that such an interference will entail a "violation" of Article 10 if it does not fall within one of the exceptions provided for in Article 10 § 2 (see Handyside v. the United Kingdom, judgment of 7 December 1976, Series A no. 24, p. 21, § 43).

  • EGMR, 24.05.1988 - 10737/84

    MÜLLER AND OTHERS v. SWITZERLAND

    Auszug aus EGMR, 29.03.2005 - 72713/01
Having regard to its own case law on the requirements of clarity and foreseeability (see Markt Intern Verlag GmbH and Klaus Beermann v. Germany, judgment of 20 November 1989, Series A no. 165, p. 18, § 30; Müller and Others v. Switzerland, judgment of 24 May 1988, Series A no. 133 p. 20, § 29), and to the fact that considerable domestic case law existed on the issue (paragraphs 27-31 above), the Court considers that the interference with the applicant's rights was prescribed by law within the meaning of Article 10 § 2 of the Convention.
  • EGMR, 23.05.1991 - 11662/85

    Oberschlick ./. Österreich

    Auszug aus EGMR, 29.03.2005 - 72713/01
Article 10 protects not only the substance of the ideas and information expressed, but also the form in which they are conveyed (see Oberschlick v. Austria (No. 1), judgment of 23 May 1991, Series A no. 204, p. 25, § 57).
  • EGMR, 20.11.1989 - 10572/83

MARKT INTERN VERLAG GMBH ET KLAUS BEERMANN c. ALLEMAGNE

  • EGMR, 26.04.1995 - 15974/90

    PRAGER ET OBERSCHLICK c. AUTRICHE

    Auszug aus EGMR, 29.03.2005 - 72713/01
Journalistic freedom also covers possible recourse to a degree of exaggeration, or even provocation (see Prager and Oberschlick v. Austria (no. 1), judgment of 26 April 1995, Series A no. 313, p. 19, § 38).
  • EGMR, 28.03.1990 - 10890/84

GROPPERA RADIO AG ET AUTRES c. SUISSE

    Auszug aus EGMR, 29.03.2005 - 72713/01
The degree of precision depends to a considerable degree on the content of the instrument at issue, the field it is designed to cover, and the number and status of those to whom it is addressed (see Groppera Radio AG and Others v. Switzerland, judgment of 28 March 1990, Series A no. 173, p. 26, § 68).
  • EGMR, 25.06.1992 - 13778/88

    THORGEIR THORGEIRSON v. ICELAND

    Auszug aus EGMR, 29.03.2005 - 72713/01
Were it otherwise, the press would be unable to play its vital role of "public watchdog" (see Thorgeir Thorgeirson v. Iceland, judgment of 25 June 1992, Series A no. 239, p. 28, § 63).
  • EGMR, 12.07.2001 - 29032/95

    FELDEK c. SLOVAQUIE

    Auszug aus EGMR, 29.03.2005 - 72713/01
A norm cannot be regarded as a "law" unless it is formulated with sufficient precision to enable the citizen to regulate his conduct: he must be able - if need be with appropriate advice - to foresee, to a degree that is reasonable in the circumstances, the consequences which a given action may entail (see, for example, Rekvényi v. Hungary [GC], no. 25390/94, § 34, ECHR 1999-III, and Feldek v. Slovakia, no. 29032/95, § 56, ECHR 2001-VIII).
  • EGMR, 08.07.1999 - 26682/95

    SÜREK c. TURQUIE (N° 1)

    Auszug aus EGMR, 29.03.2005 - 72713/01
The Court recalls that there is little scope under Article 10 § 2 of the Convention for restrictions on political speech or debates on questions of public interest (see Sürek v. Turkey (no. 1) [GC], no. 26682/95, § 61, ECHR 1999-IV).
  • EGMR, 22.09.2015 - 54608/09

    KOUTSOLIONTOS ET PANTAZIS c. GRÈCE

La Cour reconnaît d'emblée que l'article litigieux se caractérisait par un style polémique, sarcastique, incisif et provocateur (voir, mutatis mutandis, Ukrainian Media Group c. Ukraine, no 72713/01, §§ 11, 14 et 67, 29 mars 2005).
  • EGMR, 21.11.2013 - 16882/03

    PUTISTIN v. UKRAINE

The relevant domestic law on defamation and judicial practice on that issue can be found in the case of Melnychuk v. Ukraine ((dec.), no. 28743/03, ECHR 2005-IX; see also Ukrainian Media Group v. Ukraine (no. 72713/01, §§ 23-32, 29 March 2005) and Gazeta Ukraina-Tsentr v. Ukraine (no. 16695/04, §§ 18-20, 15 July 2010)).
  • EGMR, 12.02.2008 - 14385/04

    OFERTA PLUS S.R.L. v. MOLDOVA

The Court recalls that it has previously made awards in respect of non-pecuniary damage in cases where companies or other moral entities were applicants (see for example Metropolitan Church of Bessarabia and Others v. Moldova, no. 45701/99, ECHR 2001-XII; Sovtransavto Holding v. Ukraine, cited above; Ukrainian Media Group v. Ukraine, no. 72713/01, 29 March 2005; and Comingersoll S.A. v. Portugal [GC], no. 35382/97, ECHR 2000-IV).
  • EGMR, 11.10.2005 - 11039/02

    SAVITCHI v. MOLDOVA

She invoked the case of Ukrainian Media Group v. Ukraine, no. 72713/01, 29 March 2005 in which the applicant was awarded EUR 33, 000 for non-pecuniary damage.

    CEKIC and OTHERS v. CROATIA

    Auszug aus EGMR, 18.05.2004 - 72713/01
In particular, it is not its function to deal with errors of fact or law allegedly committed by a national court unless and in so far as they may have infringed rights and freedoms protected by the Convention (see, for example, Cekic and Others v. Croatia (dec.), no. 15085/02, 9 October 2003).
