BARBERÀ, MESSEGUÉ AND JABARDO v. SPAIN (ARTICLE 50)
Auszug aus EGMR, 13.12.2007 - 40998/98
The Court reiterates that there must be a clear causal link between the damage claimed and the violation of the Convention (see, among other authorities, Barberà, Messegué and Jabardo v. Spain (Article 50), 13 June 1994, §§ 16-20, Series A no. 285-C). - EGMR, 24.10.1986 - 9118/80
AGOSI c. ROYAUME-UNI
Auszug aus EGMR, 13.12.2007 - 40998/98
The second and third rules are concerned with particular instances of interference with the right to peaceful enjoyment of property and should therefore be construed in the light of the general principle enunciated in the first rule (see AGOSI v. the United Kingdom, 24 October 1986, § 48, Series A no. 108). - EGMR, 05.05.1995 - 18465/91
AIR CANADA c. ROYAUME-UNI
Auszug aus EGMR, 13.12.2007 - 40998/98
Accordingly, the second paragraph of Article 1 is applicable in the present case (see Air Canada v. the United Kingdom, 5 May 1995, § 34, Series A no. 316-A). - EKMR, 31.05.1974 - 5767/72

Turkey, Urteil vom 13.

EGMR…, Urteil vom 16. Februar 2016 - Nr. 8895/10 Ärztekammer für Wien und Dorner v. Austria - Rn. 35 f.;… Entscheidung vom 15. November 2011 - Nr. 28502/08 TRANSPETROL v. Ob die Antragstellerin mit ihren Hinweisen auf zwei Entscheidungen des Europäischen Gerichtshofs für Menschenrechte (EGMR, Islamic Republic of Iran Shipping Lines v. Turkey, Urteil vom 13. Dezember 2007, Nr. 40998/98; Trans-petrol, a.s. v. Slovakia, Urteil vom 15.

- Generalanwalt beim EuGH, 13.09.2018 - C-225/17

ÄRZTEKAMMER FÜR WIEN AND DORNER v. AUSTRIA
In order to determine whether any given legal person falls within one of the two above categories, account must be taken of its legal status and, where appropriate, the rights that status gives it, the nature of the activity it carries out, the context in which it is carried out, and the degree of its independence from the political authorities (see Radio France and Others v. France (dec.), no. 53984/00, § 26, ECHR 2003-X, and Islamic Republic of Iran Shipping Lines v. Turkey (no. 40998/98, §§ 78-81, ECHR 2007-V). - EGMR, 15.11.2011 - 28502/08
TRANSPETROL, A.S., v. SLOVAKIA
The Court reiterates that a legal entity "claiming to be the victim of a violation by one of the High Contracting Parties of the rights set forth in the Convention and the Protocols thereto" may submit an application to it, provided that it is a "non-governmental organisation" within the meaning of Article 34 of the Convention and that the idea behind this principle is to prevent a Contracting Party acting as both an applicant and a respondent party before the Court (see, for example, Islamic Republic of Iran Shipping Lines v. Turkey, no. 40998/98, § 81, ECHR 2007-V, and State Holding Company Luganksvugillya v. Ukraine (dec.), no. 23938/05, 27 January 2009). - EGMR, 05.12.2013 - 56759/08
NEGREPONTIS-GIANNISIS c.
Turquie, no 40998/98, § 114, CEDH 2007-V, et Andrejeva c. Lettonie, no 55707/00, § 111, 18 février 2009). - EGMR, 15.11.2011 - 30383/03
SIVOVA ET KOLEVA c. BULGARIE
Turquie, no 40998/98, §§ 79-81, CEDH 2007-XIV, et State Holding Company Luganksvugillya c. Ukraine (déc.), no 23938/05, 27 janvier 2009). - EGMR, 16.09.2014 - 2880/10
SAMSONOV c. RUSSIE
Turquie, no 40998/98, § 79, CEDH 2007-V). - EGMR, 18.06.2009 - 35989/02
