The Court also recalls that the positive obligations enshrined in Article 2 of the Convention, under its procedural head, require an effective independent judicial system to be set up by the authorities so that the cause of death of patients in the care of the medical profession, whether in the public or private sector, can be determined and those responsible be held accountable (see, among other authorities, Calvelli and Ciglio v.
