McCANN AND OTHERS v. THE UNITED KINGDOM
Auszug aus EGMR, 27.03.2012 - 5432/07
In the light of the importance of the protection afforded by Article 2, the Court must subject deprivation of life to the most careful scrutiny, taking into consideration not only the actions of State agents but also all the surrounding circumstances (see, among other authorities, McCann and Others v. the United Kingdom, 27 September 1995, §§ 146-147, Series A no. 324, and Avsar v. Turkey, no. 25657/94, § 391, ECHR 2001-VII (extracts)). - EGMR, 09.11.2006 - 69480/01
LOULOUÏEV ET AUTRES c. RUSSIE
Auszug aus EGMR, 27.03.2012 - 5432/07
Having regard to the previous cases concerning disappearances in Chechnya which have come before it (see, among many others, Bazorkina, cited above; Imakayeva, cited above; Luluyev and Others v. Russia, no. 69480/01, ECHR 2006 VIII (extracts); Baysayeva v. Russia, no. 74237/01, 5 April 2007; Akhmadova and Sadulayeva, cited above; Alikhadzhiyeva v. Russia, no. 68007/01, 5 July 2007; and Taymuskhanovy v. Russia, no. 11528/07, 16 December 2010), the Court finds that in the context of the conflict in the Chechen Republic, when a person is detained by unidentified servicemen without any subsequent acknowledgment of the detention, this can be regarded as life-threatening. - EGMR, 09.11.2006 - 7615/02
IMAKAÏEVA c. RUSSIE
Auszug aus EGMR, 27.03.2012 - 5432/07
The Court notes that despite its requests for a copy of the investigation file into the abduction of Milana Betilgiriyeva and Aset Yakhyayeva, the Government refused to produce an entire copy of the case file, without providing an explanation for their failure to do so, which the Court finds unacceptable (compare Imakayeva v. Russia, no. 7615/02, § 123, ECHR 2006-XIII (extracts)).

AKKUM AND OTHERS v. TURKEY
Auszug aus EGMR, 27.03.2012 - 5432/07
The burden of proof is thus shifted to the Government and if they fail in their arguments issues will arise under Article 2 and/or Article 3 (see ToÄŸcu v. Turkey, no. 27601/95, § 95, 31 May 2005, and Akkum and Others v. Turkey, no. 21894/93, § 211, ECHR 2005-II (extracts)). - EGMR, 05.07.2007 - 68007/01
ALIKHADZHIYEVA v. RUSSIA

Russie, no 14811/04, §§ 152-153, 20 janvier 2011, Kadirova et autres c. Russie, no 5432/07, §§ 127-130, 27 mars 2012, et Chitaïev c. Russie, no 59334/00, § 173, 18 janvier 2007). - EGMR, 24.07.2014 - 28761/11
Polen zahlt Schmerzensgeld für Haft in CIA-Gefängnis
That being so, the Court considers that it should be joined to the merits of that complaint and examined at a later stage (see, mutatis mutandis, Estamirov and Others v. Russia, no. 60272/00, §§ 72 and 80, 12 October 2006; and Kadirova and Others v. Russia, no. 5432/07, §§ 75-76, 27 March 2012).While it is for the applicant to make a prima facie case and adduce appropriate evidence, if the respondent Government in their response to his allegations fail to disclose crucial documents to enable the Court to establish the facts or otherwise provide a satisfactory and convincing explanation of how the events in question occurred, strong inferences can be drawn (see Varnava and Others v. Turkey [GC], nos. 16064/90, 16065/90, 16066/90, 16068/90, 16069/90, 16070/90, 16071/90, 16072/90 and 16073/90, § 184, ECHR 2009, with further references; Kadirova and Others v. Russia, no. 5432/07, § 94, 27 March 2012; and Aslakhanova and Others, cited above, § 97).

Russie, no 5432/07, 27 mars 2012, 1skandarov c. Russie, no 17185/05, §§ 25-32, 23 septembre 2010).

AL-HAWSAWI v. LITHUANIA
