McCANN AND OTHERS v. THE UNITED KINGDOM
Auszug aus EGMR, 05.04.2007 - 74237/01
The Court has to establish, first, whether the costs and expenses indicated by the applicant were actually incurred and, second, whether they were necessary (see McCann and Others v. the United Kingdom, judgment of 27 September 1995, Series A no. 324, § 220). - EGMR, 27.04.1988 - 9659/82
BOYLE AND RICE v. THE UNITED KINGDOM
Auszug aus EGMR, 05.04.2007 - 74237/01
In view of the Court's findings above with regard to Articles 2 and 3, these complaints are clearly "arguable" for the purposes of Article 13 (see Boyle and Rice v. the United Kingdom, judgment of 27 April 1988, Series A no. 131, § 52). - EGMR, 13.06.2000 - 23531/94
TIMURTAS c. TURQUIE
Auszug aus EGMR, 05.04.2007 - 74237/01
Failure on a Government's part to submit such information which is in their hands, without a satisfactory explanation, may not only give rise to the drawing of inferences as to the well-foundedness of the applicant's allegations, but may also reflect negatively on the level of compliance by a respondent State with its obligations under Article 38 § 1 (a) of the Convention (see Timurtas v. Turkey, no. 23531/94, § 66, ECHR 2000-VI).

ASLAKHANOVA AND OTHERS v. RUSSIA
Having regard to the numerous previous cases concerning disappearances in Chechnya and Ingushetia which have come before it, the Court has found that in the particular context of the conflict, when a person was detained by unidentified State agents without any subsequent acknowledgment of the detention, this could be regarded as life-threatening (see, among many others, Bazorkina v. Russia, no. 69481/01, 27 July 2006; Imakayeva v. Russia, no. 7615/02, ECHR 2006-XIII (extracts); Luluyev and Others v. Russia, no. 69480/01, ECHR 2006-VIII (extracts); Baysayeva v. Russia, no. 74237/01, 5 April 2007; Akhmadova and Sadulayeva v. Russia, no. 40464/02, 10 May 2007; Alikhadzhiyeva v. Russia, no. 68007/01, 5 July 2007; and Dubayev and Bersnukayeva v. Russia, nos. - EGMR, 05.09.2013 - 61204/09
I v. SWEDEN
Having regard to its case-law concerning disappearances and ill-treatment in Chechnya (see, among many others, Bazorkina v. Russia, no. 69481/01, 27 July 2006; Imakayeva v. Russia, no. 7615/02, ECHR 2006-XIII (extracts); Luluyev and Others v. Russia, no. 69480/01, ECHR 2006-XIII (extracts); Baysayeva v. Russia, no. 74237/01, 5 April 2007; and Akhmadova v. Russia, no. 25548/07, 3 April 2012) and having regard to the recent information on the human rights and security situation in Chechnya, the Court is well aware of on-going disappearances, of arbitrary violence, of impunity and ill-treatment in detention facilities, notably with regard to certain categories of people, such as former rebels, their relatives, political adversaries of Ramsan Kadyrov, journalists, human rights activists and individuals who have lodged complaints with international organisations. - EGMR, 21.12.2010 - 45744/08
JASINSKIS v. LATVIA
A remedy whose only consequence is a possibility to obtain compensation for the alleged violation would not suffice (ibid., see also Senses v. Turkey (dec.), no. 24991/94, 14 November 2000; Baysayeva v. Russia, no. 74237/01, §§ 108 and 109, 5 April 2007; and Dzieciak v. Poland, no. 77766/01, § 80, 9 December 2008).
- EGMR, 29.05.2008 - 29133/03
UTSAYEVA AND OTHERS v. RUSSIA
The Court notes with great concern that a number of cases have come before it which suggest that the phenomenon of "disappearances" is well known in Chechnya (see, among others, Bazorkina, cited above; Imakayeva, cited above; Luluyev and Others v. Russia, no. 69480/01, ECHR 2006-... (extracts); Baysayeva v. Russia, no. 74237/01, 5 April 2007; Akhmadova and Sadulayeva v. Russia, no. 40464/02, 10 May 2007; and Alikhadzhiyeva v. Russia, no. 68007/01, 5 July 2007). - EGMR, 23.10.2018 - 23608/16
PETROV AND X v. RUSSIA
The alleged failure to submit relevant information and documents does not raise an issue under Article 34 (see Öcalan v. Turkey [GC], no. 46221/99, § 201, ECHR 2005-IV, and Baysayeva v. Russia, no. 74237/01, § 168, 5 April 2007). - EGMR, 16.01.2014 - 38828/10
AKHMATOV AND OTHERS v. RUSSIA
Having regard to the numerous cases of disappearances in the region which have come before it, the Court has found that in the particular context of the conflict, when a person is detained by unidentified State agents without any subsequent acknowledgment of the detention, this may be regarded as life-threatening (see, among many others, Bazorkina v. - EGMR, 10.01.2008 - 67797/01
ZUBAYRAYEV v. RUSSIA
The Court has found the Russian State authorities responsible for extra-judicial executions or disappearances of civilians in Chechnya in a number of cases, even in the absence of final conclusions from the domestic investigation (see Khashiyev and Akayeva v. Russia, nos. 57942/00 and 57945/00, 24 February 2005; Luluyev and Others v. Russia, no. 69480/01, ECHR 2006-... (extracts); Estamirov and Others v. Russia, no. 60272/00, 12 October 2006; Imakayeva v. Russia, no. 7615/02, ECHR 2006-... (extracts); and Baysayeva v. Russia, no. 74237/01, 5 April 2007). - EGMR, 27.03.2012 - 5432/07
KADIROVA AND OTHERS v. RUSSIA
Having regard to the previous cases concerning disappearances in Chechnya which have come before it (see, among many others, Bazorkina, cited above; Imakayeva, cited above; Luluyev and Others v. Russia, no. 69480/01, ECHR 2006 VIII (extracts); Baysayeva v. Russia, no. 74237/01, 5 April 2007; Akhmadova and Sadulayeva, cited above; Alikhadzhiyeva v. Russia, no. 68007/01, 5 July 2007; and Taymuskhanovy v. Russia, no. 11528/07, 16 December 2010), the Court finds that in the context of the conflict in the Chechen Republic, when a person is detained by unidentified servicemen without any subsequent acknowledgment of the detention, this can be regarded as life-threatening. - EGMR, 10.10.2013 - 51534/08
GAKAYEVA AND OTHERS v. RUSSIA
Having regard to the numerous cases of disappearances in the region which have come before it, the Court has found that in the particular context of the conflict, when a person was detained by unidentified State agents without any subsequent acknowledgment of the detention, this could be regarded as life-threatening (see, among many others, Bazorkina v. Russia, nos. - EGMR, 04.07.2013 - 7461/08
