Even if his claim for solicitors' fees outlined at paragraph 42 above could also be considered in this context, no attempt has been made to clarify how certain fees were actually and necessarily incurred in domestic proceedings in order to prevent the violation or to obtain redress (see, for example, Le Compte, Van Leuven and De Meyere v. Belgium, judgment of 18 October 1982 (Article 50), Series A no. 54). - EGMR, 29.05.1986 - 9384/81

As regards the conduct of the applicant, it is recalled that applicants are entitled to make use of all procedural steps relevant to them but they should do so with diligence (Deumeland v. Germany, judgment of 29 May 1986, Series A no. 100, § 80) and they must bear the consequences when such procedural applications result in delay (Joanna Malicka-Wąsowska v. Poland, (dec.), no. 41413/98, 5 April 2001). - EGMR, 13.06.1994 - 10588/83
Auszug aus EGMR, 29.07.2004 - 42297/98
Even if the legal costs allegedly incurred as a result of the excessive delay could constitute pecuniary loss, the Court has not found a clear causal connection between the legal fees claimed and the excessive length of proceedings found to disclose a breach of Article 6 § 1 of the Convention (Barberà, Messegué and Jabardo v. Spain, judgment of 13 June 1994 (Article 50), Series A no. 285-C, §§ 16-20, and Cakıcı v. Turkey, no. 23657/94, Reports of Judgments and Decisions 1999-IV, § 127). - KAG Mainz, 25.11.2010 - M 29/10

DORAN v. IRELAND
Finally, it is recalled that, in the case of Mc Mullen v. Ireland ((dec.), no. 42297/98, 4 July 2002), the applicant also complained about the length of civil proceedings instituted by him.

It is recalled that the Convention does not lay down for the Contracting States any given manner by which it must ensure within its internal law the effective implementation of any of the provisions of the Convention, for example, by incorporating the Convention into domestic law (Silver and Others v. the United Kingdom judgment of 25 March 1983, Series A no. 61, § 111-119, and the above-cited decision in the case of Quinn v. Ireland). - EGMR, 06.12.1988 - 10588/83

This Court's task therefore is to ascertain whether the proceedings in their entirety (including appeal proceedings) were as a whole fair as required by Article 6 § 1 (Barberà, Messegué and Jabardo v. Belgium judgment of 22 April 1992, Series A no. 235-B, § 33, and Edwards v. the United Kingdom judgment of 16 December 1992, Series A no. 247-B, § 34). - EGMR, 16.12.1992 - 13071/87

However, the Court's constant case-law provides that proceedings do not have to be at an end in order for an individual to complain about their length (Joanna Malicka-Wąsowska v. Poland, (dec.), no. 41413/98, 5 April 2001, unreported). - EGMR, 21.12.2000 - 36887/97
QUINN v. IRELAND

Nevertheless, the burden of proving the existence of effective and sufficient remedies lies upon the State invoking the rule (Croke v. Ireland, (dec.), no. 33267/96, 15 June 1999, and Quinn v. Ireland, (dec.), no. 36887/97, 21 September 1999, both unreported). - EGMR, 28.03.2000 - 45738/99
BULLIVANT v. THE UNITED KINGDOM

It recalls that it is not a court of appeal from the domestic courts and cannot intervene to investigate allegations that they have reached the wrong decision on the evidence before them (see, for example, Bullivant v. the United Kingdom, (dec.), no. 45738/99, 28 March 2000, unreported).

La Cour a déjà relevé qu'une attention particulière doit être prêtée à la rapidité du recours lui-même puisqu'il n'est pas exclu que la durée excessive d'un recours le rende inadéquat (Doran c. Irlande, no 50389/99, § 57, CEDH 2003-X).
