AZINAS c. CHYPRE

STEFANETTI v. ITALY and 7 other applications
In proceeding in this way the Court has found that even reductions of 65%, as substantial as that may be, did not in the specific circumstances of the case upset the said fair balance in the very exceptional context of a punishment of a convicted and dismissed policeman (see Banfield v. the United Kingdom (dec.), no. 6223/04, ECHR 2005-XI concerning the forfeiture of part of the applicant's pension after his dismissal from the police force after a conviction).Proceeding in this way, the Court found that even a reduction of 65%, as substantial as that might be, did not in the specific circumstances of the case upset the said fair balance (see Banfield v. the United Kingdom (dec.), no. 6223/04, ECHR 2005-XI).

BÉLÁNÉ NAGY v. HUNGARY
It is noteworthy from the perspective of proportionality that she was totally divested of her pension/allowance, due to a new condition of eligibility instead of being obliged to endure a reasonable reduction, commensurate with the proportion of her accumulated social security cover, that is, 947 days instead of 1, 095 (see, mutatis mutandis, Kjartan Ásmundsson, cited above, § 45; Wieczorek, cited above, § 67; Maggio and Others v. Italy, nos. 46286/09, 52851/08, 53727/08, 54486/08 and 56001/08, § 62, 31 May 2011; Banfield v. the United Kingdom (dec.), no. 6223/04, 18 October 2005; and Lakicevic and Others, cited above, § 72).

VALKOV AND OTHERS v. BULGARIA
They can therefore hardly be regarded as being made to bear an excessive and disproportionate burden, or as having suffered an impairment of the essence of their pension rights (see, mutatis mutandis, M.V. and U-M.S. v. Finland (dec.), no. 43189/98, 28 January 2003; Saarinen v. Finland (dec.), no. 69136/01, 28 January 2003; Banfield v. the United Kingdom (dec.), no. 6223/04, ECHR 2005-XI; Laloyaux v. Belgium (dec.), no. 73511/01, 9 March 2006; and Wieczorek, § 71; Hasani; and Maggio and Others, § 62, all cited above; and contrast Kjartan Ásmundsson, §§ 43-45, and Apostolakis, §§ 39-42, both cited above). - EGMR, 17.01.2023 - 54805/15
ZEGARAC v. SERBIA and 10 other applications
However, the Court does not uphold the applicants' argument (see paragraph 65 above) that the reduction in pension payments amounted to a "deprivation of possessions" within the meaning of the second sentence of the first paragraph of Article 1 of Protocol No. 1 (see Banfield v. the United Kingdom (dec.), no. 6223/04, ECHR 2005-XI). - EGMR, 31.01.2012 - 10212/07

- EGMR, 13.12.2011 - 27458/06
LAKICEVIC AND OTHERS v. MONTENEGRO AND SERBIA
It could have been otherwise had the applicants been obliged to endure a reasonable and commensurate reduction rather than the total suspension of their entitlements (see, among many authorities, Kjartan Ásmundsson, cited above, § 45; Wieczorek v. Poland, cited above, § 67, Maggio and Others v. Italy, cited above, § 62, Banfield v. the United Kingdom (dec.), no. 6223/04, 18 October 2005) or if the legislature had afforded them a transitional period within which to adjust themselves to the new scheme. - EGMR, 14.06.2016 - 71148/10
PHILIPPOU v. CYPRUS
Drawing guidance from the Court's case-law, and in particular the judgments in the case of Azinas v. Cyprus (no. 56679/00, 20 June 2002, and [GC], no. 56679/00, ECHR 2004-III), and the decision in the case of Banfield v. the United Kingdom ((dec.), no. 6223/04, ECHR 2005-XI), the Supreme Court first pointed to those factors which justified the deprivation of the right to property in this case. - EGMR, 22.10.2009 - 39574/07
[FRE]
Royaume-Uni, (déc.), no 6223/04, 18 octobre 2005).
