Rn. 77 As regards the remaining question whether the limitation of the applicant's access to information held on him by the BVD was "necessary in a democratic society", the Court reiterates that the notion of necessity implies that the interference corresponds to a pressing social need and, in particular, that it is proportionate to the legitimate aim pursued, and that - although the national authorities enjoy a certain margin of appreciation in assessing the pressing social need in a particular case - there should exist adequate and effective guarantees against abuse, since a system of secret surveillance designed to protect national security entails the risk of undermining or even destroying democracy on the ground of defending it (see Leander v. Sweden , judgment of 26 March 1987, Series A no. 116, p. 25, §§ 58-60). - EKMR, 04.03.1991 - 14084/88

Firstly, the courts that dealt with those proceedings did not see the material (if there was indeed any) to which the Agency's decision related (contrast Brinks v. the Netherlands (dec.), no. 9940/04, 5 April 2005, and Das Universelle Leben Aller Kulturen Weltweit e.V. v. Germany (dec.), no. 60369/11, § 24, 17 November 2015). - EGMR, 17.11.2015 - 60369/11
DAS UNIVERSELLE LEBEN ALLER KULTUREN WELTWEIT E.V. v. GERMANY
46, ECHR 2000-V;… Leander./. Schweden, 26. März 1987, Rdnr. 48, Serie A Band 116; Brinks./.
