EGMR, Urteil vom 5. März 2009, a. a. O.).

France, no 31684/05, § 42, 5 mars 2009, Galstyan c. Arménie, no 26986/03, § 114, 15 novembre 2007), a fortiori lorsque la restriction constitue une mesure générale d'interdiction. - EGMR, 26.11.2013 - 37553/05

As a general principle, the Court nevertheless reiterates that any demonstration in a public place inevitably causes a certain level of disruption to ordinary life, including disruption of traffic, and that it is important for the public authorities to show a certain degree of tolerance towards peaceful gatherings if the freedom of assembly guaranteed by Article 11 of the Convention is not to be deprived of all substance (see Galstyan, cited above, §§ 116-117; Bukta and Others v. Hungary, no. 25691/04, § 37, ECHR 2007-III; Oya Ataman, cited above, §§ 38-42; and Barraco v. France, no. 31684/05, § 43, 5 March 2009).[16] Barraco v. France, no. 31684/05, 5 March 2009.

Mariya Alekhina u.a. ./. Russland - "Pussy Riot"-Urteil verletzt Meinungsfreiheit
In that regard, the ADF referred to several cases where the Court had found a restriction on the manner and form of expression to be proportionate as long as the expression itself had not been prohibited from taking place (they referred, inter alia, to Rai, Allmond and "Negotiate Now" v. The United Kingdom (dec.), no. 25522/94, 6 April 1995, and Barraco v. France, no. 31684/05, 5 March 2009, both cases examined under Article 11). - EGMR, 05.01.2016 - 74568/12
Russland verurteilt: 25.000 Euro wegen Festnahme nach Demo
When examining whether restrictions on the rights and freedoms guaranteed by the Convention can be considered "necessary in a democratic society" the Contracting States enjoy a certain but not unlimited margin of appreciation (see Barraco v. France, no. 31684/05, § 42, 5 March 2009). - EGMR, 07.02.2017 - 57818/09
LASHMANKIN v. RUSSIA and 14 other applications
Indeed, the protection of personal opinions, secured by Article 10 of the Convention, is one of the objectives of freedom of peaceful assembly as enshrined in Article 11 of the Convention (see Ezelin, cited above, § 37; Djavit An v. Turkey, no. 20652/92, § 39, ECHR 2003-III; and Barraco v. France, no. 31684/05, § 29, 5 March 2009). - EGMR, 06.10.2020 - 16435/10
NCHR AND OTHERS v. RUSSIA and 1 other application
It is also pertinent to reiterate, in view of the context being examined in the present case, that protests, including actions taking the form of physically impeding certain activities, can constitute expressions of opinion within the meaning of Article 10 of the Convention (see Steel and Others v. the United Kingdom, 23 September 1998, § 92, Reports of Judgments and Decisions 1998-VII; Hashman and Harrup v. the United Kingdom [GC], no. 25594/94, § 28, ECHR 1999-VIII; Lucas v. the United Kingdom (dec.), no. 39013/02, 18 March 2003; Açık and Others v. Turkey, no. 31451/03, § 40, 13 January 2009; Taranenko v. Russia, no. 19554/05, §§ 69-71, 15 May 2014; and Słomka v. Poland, no. 68924/12, § 58, 6 December 2018; see also Chorherr v. Austria, 25 August 1993, §§ 7-8 and 23, Series A no. 266-B; Barraco v. France, no. 31684/05, §§ 26-27, 5 March 2009; and Kudrevičius and Others v. Lithuania [GC], no. 37553/05, §§ 20-22 and 85-86, ECHR 2015).The case of Barraco v. France (no. 31684/05, 5 March 2009), which also concerned a demonstration on a motorway, likewise ended with a finding of no violation of Article 10. As it is summarised in the Information Note of the Court published on HUDOC, the case related to Article 11 § 1 on freedom of peaceful assembly.

Thus, it should not be interpreted restrictively (see Djavit An v. Turkey, no. 20652/92, § 56, ECHR 2003-III, and Barraco v. France, no. 31684/05, § 41, 5 March 2009). - EGMR, 26.04.2016 - 25501/07
