BELLI ET ARQUIER-MARTINEZ c. SUISSE
France, no 40892/98, §§ 43 et suivants, CEDH 2003-X, Kjartan Ásmundsson c. Islande, no 60669/00, §§ 39 et suivants, CEDH 2004-IX, ou encore Wieczorek c. Pologne, no 18176/05, §§ 56 et suivants, 8 décembre 2009).

The Court, in deference to the findings of the domestic courts, has already accepted that the reopening of proceedings on the basis of that provision, following the discovery of the welfare authority's own mistake in its original assessment of the eligibility for a benefit, was provided for by law (see Moskal v. Poland, no. 10373/05, §§ 55-56, 15 September 2009). - EGMR, 04.12.2012 - 34386/04
LEW v. POLAND
This case and the other cases are based on the same or at least very similar circumstances as in Moskal v. Poland (no. 10373/05, 15 September 2009) and Lewandowski v. Poland (no. 38459/03, 2 October 2012) as regards the revocation of the early retirement pension (the EWK pension) following a review of the applicant's dossier.

- EGMR, 16.05.2013 - 49317/07

The good governance principle should not, as a general rule, prevent the authorities from correcting occasional mistakes, even those resulting from their own negligence (see Moskal v. Poland, no. 10373/05, § 73, 15 September 2009). - EGMR, 24.11.2020 - 75414/10
KURBAN v. TURKEY
The Court would reiterate at this juncture that it has held in the context of social security payments that the authorities should not be prevented from correcting their mistakes, even those resulting from their own negligence, because holding otherwise would be contrary to the doctrine of unjust enrichment (see Moskal v. Poland, no. 10373/05, § 73, 15 September 2009). - EGMR, 04.12.2012 - 11815/05

It requires that where an issue pertaining to the general interest is at stake, especially when it affects fundamental human rights, including property rights, the public authorities must act promptly and in an appropriate and above all consistent manner (see Beyeler v. Italy [GC], no. 33202/96, § 120, ECHR 2000-I; Öneryıldız v. Turkey [GC], no. 48939/99, § 128, ECHR 2004-XII; Megadat.com S.r.l. v. Moldova, no. 21151/04, § 72, 8 April 2008; and Rysovskyy v. As in the Moskal case the Court considers that this interference was provided for by law and pursued a legitimate aim, as required by Article 1 of Protocol No. 1 to the Convention (see Moskal, cited above, §§ 56, 57 and 61-63 and also Iwaszkiewicz v. Poland, no. 30614/06, §§ 47, 48, 26 July 2011).
