Polizeiliche Tatprovokation (Begriff: mittelbare Tatprovokation - Bestimmtsein …

Die Beteiligung des Beschwerdeführers an den innerstaatlichen Verfahren ist nur eines von verschiedenen maßgeblichen Kriterien (…siehe N../. Deutschland, 25. VETRENKO v. MOLDOVA

In Gradinar v. Moldova (no. 7170/02, § 117, 8 April 2008) the Court found a violation of Article 6 since "the domestic courts chose simply to remain silent with regard to a number of serious violations of the law noted by the lower court and to certain fundamental issues, such as the fact that the accused had an alibi for the presumed time of the murder.".

In reaching their conclusion, the majority place reliance on the judgment of the Chamber in GrÇŽdinar v. Moldova (No. 7170/02, 8 April 2008), where the Court similarly found a violation of Article 6 on the grounds of the insufficiency of the reasons given by the appellate courts to support the applicant's conviction.

    GEROVSKA-POPCHEVSKA v. NORTH MACEDONIA

The Court reiterates that the right to enjoy a good reputation is a "civil right" within the meaning of Article 6 § 1 (see, for example, Madaus v. Germany, no. 44164/14, § 15, 9 June 2016, with further references, and Grădinar v. Moldova, no. 7170/02, § 92, 8 April 2008).

    SKRCHESKI v.

  • EGMR, 17.09.2024 - 15887/15

    YAYLALI v. SERBIA

Rn. 6 The Court has recognised that in its assessment of whether close relatives have standing to submit an application, the applicant's participation in the domestic proceedings can be a relevant criterion among several others (see Nölkenbockhoff v. Germany, 25 August 1987, § 33, Series A no. 123; Micallef v. Malta [GC], no. 17056/06, §§ 48-49, ECHR 2009; Polanco Torres and Movilla Polanco v. Spain, no. 34147/06, § 31, 21 September 2010; and Grădinar v. Moldova, no. 7170/02, §§ 98-99, 8 April 2008).
  • EGMR, 21.06.2016 - 15256/05

    [FRE]

However, even though a domestic court has a certain margin of appreciation when choosing arguments in a particular case and admitting evidence in support of the parties' submissions, the injured party can expect a specific and express reply from the court to those submissions which are decisive for the outcome of the proceedings in question (see Hiro Balani v. Spain, 9 December 1994, §§ 27-28, Series A no. 303-B; Grădinar v. Moldova, no. 7170/02, §§ 107-108, 8 April 2008; and Gheorghe v. Romania, no. 19215/04, § 43, 15 March 2007).
  • EGMR, 01.09.2009 - 38308/05

    WNUK v. POLAND

The Court does not exclude, that in the circumstances of a particular case a Supreme Court may be required to give more adequate reasons for its judgments (see Yanakiev v. Bulgaria, no. 40476/98, § 72, 10 August 2006; Gheorghe v. Romania, no. 19215/04, § 50, ECHR 2007-... (extracts); Wagner and J.M.W.L. v. Luxembourg, no. 76240/01, § 96, ECHR 2007-... (extracts); Gradinar v. Moldova, no. 7170/02, § 115, 8 April 2008; Velted-98 AD v. Bulgaria, no. 15239/02, § 48, 11 December 2008).
  • EGMR, 05.07.2011 - 55508/07

    JANOWIEC AND OTHERS v. RUSSIA

On the other hand, the Court has held that Article 6 applies under its civil head to rehabilitation proceedings in so far as such proceedings concern the right of the applicants to defend their reputation and that of their deceased relatives (see Brudnicka and Others v. Poland, no. 54723/00, §§ 24-34, ECHR 2005-II; Kurzac v. Poland (dec.), no. 31382/96, 25 May 2000; and also Gradinar v. Moldova, no. 7170/02, §§ 96-98, 8 April 2008).
  • EGMR, 28.07.2009 - 30754/04

    DVORACEK AND DVORACKOVA v. SLOVAKIA

However complaints brought under, inter alia, Article 6 § 1 do not in principle fall within this category (see Gradinar v. Moldova, no. 7170/02, § 91, 8 April 2008; Biç and Others v. Turkey, no. 55955/00, § 22, 2 February 2006 and Georgia Makri and others v. Greece (dec.), no. 5977/03, 24 March 2005).
  • EGMR, 14.06.2016 - 60103/11

    STEPANIAN c. ROUMANIE

    Dans d'autres affaires concernant des griefs tirés des articles 5, 6 et 8, la Cour a reconnu la qualité de victime à des proches qui avaient démontré l'existence d'un intérêt moral (Nölkenbockhoff c. Allemagne, 25 août 1987, § 33, série A no 123, et Grădinar c. Moldova, no 7170/02, §§ 95 et 97-98, 8 avril 2008) ou un intérêt matériel dans l'affaire (Ressegatti c. Suisse, no 17671/02, §§ 23-25, 13 juillet 2006, Marie-Louise Loyen et Bruneel c. France, no 55929/00, §§ 29-30, 5 juillet 2005, Nölkenbockhoff, précité, § 33, et Micallef c. Malte [GC], no 17056/06, § 48, CEDH 2009,).
