Rejetant le grief formulé par le requérant dans l'affaire Konttinen c. Finlande [no 24949/94, décision de la Commission du 3 décembre 1996, DR 87-B, p. 68], la Commission a souligné (§ 1, p. 75) que l'intéressé n'avait pas été poussé à revenir sur ses opinions religieuses ni empêché de manifester sa religion ou sa conviction ; ayant constaté que ses heures de travail étaient en conflit avec ses convictions religieuses, il lui était loisible de renoncer à ses fonctions (...) Dans l'affaire Stedman c. Royaume-Uni [no 29107/95, décision de la Commission du 9 avril 1997, DR 89-B], l'élément qui a conduit au constat de non-violation de l'article 9 était que la requérante était libre de démissionner plutôt que de travailler le dimanche.Surtout, dans les cas de restrictions imposées par l'employeur à la possibilité pour l'employé de se livrer à des pratiques religieuses, la Commission a conclu dans plusieurs décisions à l'absence d'ingérence dans l'exercice de la liberté de religion du requérant au motif que celui-ci pouvait démissionner de ses fonctions et trouver un autre travail (voir, par exemple, Konttinen c. Finlande, no 24949/94, décision de la Commission du 3 décembre 1996, DR 87-B, p. 68, et Stedman c. Royaume-Uni, no 29107/95, décision de la Commission du 9 avril 1997, DR 89-B, p. 104 ; à comparer avec Kosteski c. l'ex-République yougoslave de Macédoine, no 55170/00, § 39, 13 avril 2006).

In this regard the Government relied, by analogy, on Stedman v the United Kingdom, application no. 29107/95, decision of 9 April 1997, in which the Commission rejected as inadmissible a complaint under Article 9 of the Convention by a Christian applicant who had been dismissed because she refused to work on Sundays.Like the House of Lords in the case of R v. Secretary of State for Employment, ex parte Seymour-Smith and another, we consider that it was and is in principle reasonable and appropriate for the State to lay down a qualifying period and that the period set in the United Kingdom cannot be said to fall outside any acceptable margin of appreciation (see, in the context of a complaint under Article 6 of the Convention, Stedman v. the United Kingdom, application no. 29107/95, decision of 9 April 1997, in which a restriction on access to an industrial tribunal for unfair dismissal to employees of two years" standing was held to pursue a legitimate aim and not to be arbitrary or to impair the very essence of the right of access to a court).
