37. The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. France [GC], no. 30979/96, § 43, ECHR 2000-VII).

Einzelpersonen hat der EGMR aber abgesehen von besonderen Fallkonstellationen, insbesondere beim offensichtlichen Bestehen eines Informationsanspruches schon nach innerstaatlichem Recht (EGMR vom 26.5.2009 - 31475/05 - Kenedi gegen Ungarn), keine Informationsansprüche nach Art. 10 EMRK zugebilligt (…vgl. dazu Menschig in Karpenstein/Mayer, EMRK, München 2012, Art. 10 Rn. 14 zum Umfang der vom EGMR geschützten Pressefreiheit).Die Entscheidung betrifft damit im Gegensatz zum vorliegenden Fall einen Sachverhalt, bei dem die Informationsquellen schon aufgrund innerstaatlichen Rechts zur öffentlichen Zugänglichkeit bestimmt waren und in denen die dortige Exekutive (nicht aber wie hier die Legislative!) in einem Akt willkürlicher Zensur den bereits rechtskräftig festgestellten Anspruch auf Informationszugang vereitelte (eine solche Sachverhaltskonstellation der Vereitelung eines bereits innerstaatlich bestehenden Informationsanspruches behandelt auch EGMR vom 26.5.2009 - 31475/05 - Kenedi gegen Ungarn).

As regards the nature of the information sought, the Court has found in previous cases that the denial of access to information constituted an interference with the applicants' right to receive and impart information in situations where the data sought amounted to "factual information concerning the use of electronic surveillance measures" (see Youth Initiative for Human Rights, cited above, § 24), "information about a constitutional complaint" and "on a matter of public importance" (see Társaság a Szabadságjogokért, cited above, §§ 37-38), "original documentary sources for legitimate historical research" (see Kenedi v. Hungary, no. 31475/05, § 43, 26 May 2009), decisions concerning real property transaction commissions (see Österreichische Vereinigung zur Erhaltung, Stärkung und Schaffung, cited above, § 42) and the names of public defenders and the number of times they had been appointed, in the context of conducting a survey (see Magyar Helsinki Bizottság, cited above, § 180). - EGMR, 07.06.2022 - 32401/10

In light of recent decisions of this Court, namely Társaság a Szabadságjogokért v. Hungary, no. 37374/05, 14 April 2009, and Kenedi v. Hungary, no. 31475/05, 26 May 2009, Mr Kennedy argued in particular that pursuant to section 3 of the Human Rights Act 1998 (see paragraph 77 below), section 32(2) of the FOIA should be interpreted in a way compatible with the Convention, including in particular the right to freedom of expression guaranteed by Article 10.Although a number of recent Chamber judgments had departed from this position, the majority Justices were of the view that they had failed to give a clearly reasoned analysis of the matter or to explain why they had departed from earlier authority (citing Sdruzení Jihoceské Matky v. the Czech Republic (dec.), no. 19101/03, 10 July 2006; Társaság a Szabadságjogokért v. In der Rechtssache Kenedi./. Ungarn (Individualbeschwerde Nr. 31475/05, 26. Mai 2009), in der es darum ging, dass der Beschwerdeführer innerhalb angemessener Frist keine Vollstreckung einer rechtskräftigen gerichtlichen Entscheidung erlangen konnte, die ihm Zugang zu verwahrten Dokumenten gewährt hätte, stellte der Gerichtshof fest, dass die innerstaatlichen Gerichte das Bestehen des Anspruchs anerkannt hatten, der dem von dem Beschwerdeführer angestrebten Zugang zu den Dokumenten zugrunde lag, und dass der Beschwerdeführer als Geschichtswissenschaftler diesen Zugang benötigte, um eine historische Studie zu veröffentlichen, was die durch Artikel 10 der Konvention garantierte Meinungsfreiheit des Beschwerdeführers betraf. - EGMR, 27.10.2009 - 21737/03
