KASHLEV v. ESTONIA
Nevertheless, the Court has held that where an appellate court is called upon to examine a case as to the facts and the law and to make a full assessment of the question of the applicant's guilt or innocence, it cannot, as a matter of fair trial, properly determine those issues without a direct assessment of the evidence given in person by the accused who claims that he has not committed the act alleged to constitute a criminal offence (see Ekbatani, cited above, § 32, and Popovici v. Moldova, nos. 289/04 and 41194/04, § 68, 27 November 2007).289/04 and 41194/04, § 73, 27 November 2007).

BIVOLARU c. ROUMANIE
Suède, 26 mai 1988, § 32, série A no 134, Constantinescu, précité, § 55, et Popovici c. Moldova, nos 289/04 et 41194/04, § 68, 27 novembre 2007). - EGMR, 15.09.2015 - 11353/06

In the circumstances, the Court finds that the declarations by the Russian courts to the effect that Mr Vitaliy Vulakh had been the head of a criminal gang which had committed serious crimes under his leadership, before he was convicted, amounted to a breach of his right to be presumed innocent (compare Popovici v. Moldova, nos. 289/04 and 41194/04, §§ 76-79, 27 November 2007). - LSG Sachsen-Anhalt, 16.12.2010 - L 1 R 187/08

LOREFICE c. ITALIE
Espagne, no 61112/12, § 33, 29 mars 2016). - EGMR, 05.07.2011 - 15868/07
