Moreover, legal costs are only recoverable in so far as they relate to the violation found (see Van de Hurk v. the Netherlands, judgment of 19 April 1994, Series A no. 288, p. 21, § 66). - EGMR, 22.03.2001 - 34044/96

Lastly, the Court reiterates that the Convention must be applied in accordance with the principles of international law, in particular with those relating to the international protection of human rights (see Streletz, Kessler and Krenz v. Germany [GC], nos. 34044/96, 35532/97 and 44801/98, § 90, ECHR 2001-II, and Al-Adsani v. the United Kingdom [GC], no. 35763/97, § 55, ECHR 2001-XI). - EGMR, 26.05.1994 - 16969/90
Auszug aus EGMR, 26.06.2003 - 48206/99
In both contexts regard must be had to the fair balance that has to be struck between the competing interests of the individual and of the community as a whole; and in both contexts the State enjoys a certain margin of appreciation (see Keegan v. Ireland, judgment of 26 May 1994, Series A no. 290, p. 19, § 49).

HOKKANEN v. FINLAND
Auszug aus EGMR, 26.06.2003 - 48206/99
What is decisive in this case is whether the Portuguese authorities took all the necessary steps that could reasonably be demanded of them to facilitate the enforcement of the decision of the French courts granting the applicant sole custody of and parental responsibility for his child (see Hokkanen v. Finland, judgment of 23 September 1994, Series A no. 299-A, p. 22, § 58). - KAG Münster, 28.01.2010 - 26/09

NUUTINEN v. FINLAND
Auszug aus EGMR, 26.06.2003 - 48206/99
In relation to the State's obligation to take positive measures, the Court has repeatedly held that Article 8 includes a parent's right to the taking of measures with a view to his being reunited with his child and an obligation on the national authorities to take such measures (see, among other authorities, Ignaccolo-Zenide v. Romania, no. 31679/96, § 94, ECHR 2000-I, and Nuutinen v. Finland, no. 32842/96, § 127, ECHR 2000-VIII).
- EGMR, 14.01.2020 - 10926/09
RINAU v. LITHUANIA
On the basis of the facts of the case, the Court takes the view that the suspensions that followed I.R.'s applications for the proceedings to be reopened (see paragraphs 76, 78 and 79 above) were particularly aptly dubbed "procedural vagaries" that had not been prevented by the Supreme Court in spite of its duty to act expeditiously (see Article 11 of the Hague Convention, cited in paragraph 145 above; also see, for example, Maire v. Portugal, no. 48206/99, § 74, ECHR 2003-VII; point 104 of the Pérez-Vera Report cited in paragraph 147 above and paragraph 148 above). - EGMR, 01.10.2026 - 11997/25
AVETYAN v. ARMENIA
The Court reiterates that it is up to the competent authorities to impose appropriate sanctions - even of their own motion - in the event of a lack of cooperation on the part of the persons with whom a child is living (see Maire v. Portugal, no. 48206/99, § 76, ECHR 2003-VII; Sévère v. Austria, no. 53661/15, § 98, 21 September 2017; and Tzioumaka, cited above, § 86). - EGMR, 17.09.2026 - 34524/23
PJEVIĆ v. SERBIA
- EGMR, 06.12.2005 - 14600/05
ESKINAZI ET CHELOUCHE c. TURQUIE
Portugal, no 48206/99, § 68, CEDH 2003-VII). - EGMR, 11.06.2013 - 20255/12
PRIZZIA v. HUNGARY
However, even if the domestic legal order did not allow for the imposition of effective sanctions, each Contracting State must equip itself with an adequate and sufficient legal arsenal to ensure compliance with the positive obligations imposed on it by Article 8 of the Convention and the other international agreements it has chosen to ratify (see Maire v. Portugal, no. 48206/99, § 76, ECHR 2003-VII). - EGMR, 18.01.2011 - 26755/10

Portugal , Individualbeschwerde Nr. 48206/99, Rdnrn. 74 und 76, ECHR 2003-VII). - EGMR, 13.07.2006 - 37284/02
LAFARGUE c. ROUMANIE
Eu égard aux circonstances de la cause et aux sommes accordées dans des affaires comparables (Ignaccolo-Zenide, § 117, Iglesias Gil and A.U.I., § 67, Maire c. Portugal, no 48206/99, § 82, CEDH 2003-VII, Hansen v. Turkey, § 115, et Monory c. Roumanie et Hongrie, no 71099/01, § 96, 5 avril 2005) et statuant en équité comme le veut l'article 41, elle lui alloue 15 000 EUR à ce titre. - EGMR, 16.04.2015 - 53565/13
MITOVI v. "THE FORMER YUGOSLAV REPUBLIC OF MACEDONIA"
In this context, the adequacy of a measure is to be judged by the swiftness of its implementation, as the passage of time can have irremediable consequences for relations between the child and the non-resident parent (see Krivosej v. Serbia, no. 42559/08, § 52, 13 April 2010; Felbab v. Serbia, no. 14011/07, § 67, 14 April 2009; and Maire v. Portugal, no. 48206/99, § 74, ECHR 2003-VII). - EGMR, 27.07.2006 - 7198/04
IOSUB CARAS v. ROMANIA
Having regard to the sums awarded in comparable cases (see Ignaccolo-Zenide, § 117; Sylvester, § 84; Iglesias Gil and A.U.I., § 67, and Monory, § 96, cited above, Sophia Gudrun Hansen v. Turkey, no. 36141/97, § 115, 23 September 2003, as well as Maire v. Portugal, no. 48206/99, § 82, ECHR 2003-VII), and making an assessment on an equitable basis as required by Article 41, the Court awards the first applicant EUR 20, 000 under this head. - EGMR, 02.09.2003 - 56838/00
GUICHARD contre la FRANCE
La Cour considère que la présente affaire doit être distinguée des affaires Ignaccolo-Zenide précitée, Maire c. Portugal (no 48206/99, 26 juin 2003) ou encore Iglesias Gil et A.U.I. c. Espagne (no 56673/00, CEDH 2003). - EGMR - 37598/25 (anhängig)
