The Court reiterates that the reasonableness of the length of proceedings must be assessed in the light of the circumstances of the case and with reference to the following criteria: the complexity of the case, the conduct of the applicant and the relevant authorities and what was at stake for the applicant in the dispute (see, among many other authorities, Frydlender v. Article 13 therefore offers an alternative: a remedy will be considered "effective" if it can be used either to expedite a decision by the courts dealing with the case, or to provide the litigant with adequate redress for delays that have already occurred (see Mifsud v. In this connection, the Court notes that the effectiveness of a remedy may depend on whether it has a significant effect on the length of the proceedings as a whole (see Holzinger v. The European Court has accepted that the remedy provided for in Article 217a of the former CCvP is effective in principle (see Simizov against Bulgaria, No. 59523/00, § 56, 18 October 2007, Jeliazkov and others against Bulgaria, No. 9143/02, § 48, 3 April 2008, and Stefanova against Bulgaria, No. 58828/00, § 69, 11 January 2007).In cases concerning chiefly delays occurring prior to July 1999 the Court did not find it necessary to determine whether the "complaint about delays" was an effective remedy on the basis that even if it was, it had been introduced too late to make up for the delay which had already accrued (see Djangozov v. En l'espèce, dans la mesure où les principaux retards dans le cours de la procédure, qui ont motivé le constat de violation de l'article 6 § 1 (paragraphes 28-30 ci-dessus), sont survenus avant l'adoption l'article 217a, la Cour estime que le recours ainsi instauré n'était pas en mesure de réparer ou d'apporter une compensation pour les retards déjà intervenus (voir Simizov c. Bulgarie, no 59523/00, § 56, 18 octobre 2007 ; Kouyoumdjïan c. Bulgarie, no 77147/01, § 47, 24 mai 2007).

Elle rappelle ensuite qu'elle a déjà admis l'efficacité de principe du recours prévu à l'article 217a du CPC de 1952 (Simizov c. Bulgarie, no 59523/00, § 56, 18 octobre 2007, Jeliazkov et autres c. En l'espèce, compte tenu de la reconnaissance des violations contenue dans la déclaration du Gouvernement, de la somme proposée, qui constitue une réparation adéquate au sens de sa jurisprudence, ainsi que du fait qu'elle a déjà examiné des affaires concernant des griefs similaires à ceux du requérant (voir, parmi beaucoup d'autres, Simizov c.
