Ein solcher Hinweis ist allenfalls als Ausdruck eines Verdachts in Bezug auf eine noch nachzuweisende Verantwortlichkeit von Scania anzusehen, der keinen Verstoß gegen die Unschuldsvermutung darstellt (vgl. in diesem Sinne und entsprechend EGMR, 27. Februar 2014, Karaman/Deutschland, CE:ECHR:2014:0227JUD001710310, § 63, und 31. Oktober 2017, Bauras/Litauen, CE:ECHR:2017:1031JUD005679513, § 51 und die dort angeführte Rechtsprechung).Obwohl zweitens das Vorliegen eines ausdrücklichen Hinweises im Vergleichsbeschluss, dass es zu diesem Zeitpunkt noch kein Ergebnis in Bezug auf die Verantwortlichkeit von Scania nach Art. 101 AEUV gebe, den Willen der Kommission zeigt, ihrer Pflicht nachzukommen, den Grundsatz der Unschuldsvermutung zu wahren, wie er in der Rechtsprechung des EGMR aufgestellt worden ist (vgl. in diesem Sinne EGMR, 27. Februar 2014, Karaman/Deutschland, CE:ECHR:2014:0227JUD001710310, §§ 67, 69 und 70, und 31. Oktober 2017, Bauras/Litauen, CE:ECHR:2017:1031JUD005679513, § 54), nämlich klar anzugeben, dass gegen Scania ein gesondertes Strafverfahren anhängig sei und dass ihre Verantwortlichkeit noch nicht rechtsförmlich festgestellt sei (…vgl. in diesem Sinne Urteil vom 5. September 2019, AH u. a. [Unschuldsvermutung], C-377/18, EU:C:2019:670, Rn. 45), reicht dies jedoch für sich genommen nicht aus, um einen Verstoß gegen diesen Grundsatz auszuschließen, wie die Kommission in der mündlichen Verhandlung im Wesentlichen eingeräumt hat.
Folglich muss die Kommission dafür Sorge tragen, dass die von den Vergleichsparteien zugegebenen Tatsachen nicht in Bezug auf eine nicht an diesem Verfahren teilnehmende Partei wie Scania akzeptiert werden, ohne dass im ordentlichen Verfahren eine vollständige und angemessene Prüfung anhand der von dieser Partei vorgetragenen Argumente und Beweise erfolgt (vgl. in diesem Sinne und entsprechend EGMR, 23. Februar 2016, Navalnyy und Ofitserov/Russland, CE:ECHR:2016:0223JUD004663213, §§ 103 bis 105, und vom 31. Oktober 2017, Bauras/Litauen, CE:ECHR:2017:1031JUD005679513, § 53).
