Another relevant consideration is the need to ensure that the police exercise their powers to control and prevent crime in a manner which fully respects the due process and other guarantees which legitimately place restraints on the scope of their action to investigate crime and bring offenders to justice (see Opuz v. Turkey, no. 33401/02, §§ 129-30, ECHR 2009).

Article 2 of the Convention requires the State not only to refrain from the "intentional" taking of life, but also to take appropriate steps to safeguard the lives of those within its jurisdiction (see Calvelli and Ciglio v. Italy [GC], no. 32967/96, § 48, ECHR 2002-I).

    IMAKAÏEVA c. RUSSIE

    Auszug aus EGMR, 08.07.2021 - 33056/17
The Court reiterates that there must be a clear causal connection between the pecuniary damage claimed by the applicant and the violation of the Convention, and that this may, where appropriate, include compensation for loss of earnings (see, among other authorities, Imakayeva v. Russia, no. 7615/02, § 213, ECHR 2006-XIII (extracts)).

    KONTROVA c. SLOVAQUIE

Secondly, in appropriate circumstances there is a duty on the authorities to take preventive operational measures to protect an individual whose life is at risk from the criminal acts of another individual (see Kontrová v. Slovakia, no. 7510/04, § 49, 31 May 2007).

    Auszug aus EGMR, 08.07.2021 - 33056/17
The Court reiterates that the obligation to protect life under Article 2 of the Convention requires that there be some form of effective official investigation when individuals have been killed either by State officials or private individuals (see Mazepa and Others v. Russia, no. 15086/07, § 69, 17 July 2018).

    A AND B v. GEORGIA

Other relevant domestic law, as well as international material concerning violence against women in Georgia, is comprehensively summarised in paragraphs 25-40 of the Court's judgment in the case of Tkhelidze v. Georgia (no. 33056/17, 8 July 2021).

The Court's assessment 39. Having regard to the applicants' allegations that the authorities' double failure - the lack of protection of their next of kin from domestic violence and the absence of an effective investigation into the law-enforcement authorities' inaction - stemmed from their insufficient acknowledgment of the phenomenon of discrimination against women, the Court finds, firstly, that the most appropriate way to proceed would be to subject the complaints to a simultaneous dual examination under Article 2 taken in conjunction with Article 14 of the Convention (see Tkhelidze v. Georgia, no. 33056/17, § 47, 8 July 2021, with further references).

    ELVAN c.

Turquie, no 25657/94, §§ 398-406, ECHR 2001-VII (extraits), Mazepa et autres c. Russie, no 15086/07, §§ 75-79, 17 juillet 2018, Ribcheva et autres c. Bulgarie, nos 37801/16 et 2 autres, §§ 125-130, 30 mars 2021 et Tkhelidze c. Géorgie, no 33056/17, §§ 58-59, 8 juillet 2021).
  • EGMR, 19.01.2023 - 32667/19

DOMENECH ARADILLA AND RODRÍGUEZ GONZÁLEZ v. SPAIN

In cases of domestic violence, where the victims are most often women, the Court has not hesitated to find violations not only of Articles 2 and 3, but also of Article 14 (see, for example, Opuz v. Turkey, no. 33401/02, ECHR 2009; Talpis v. Italy, no. 41237/14, 2 March 2017; Tunikova and Others v. The ensuing internal investigation furthermore noted that the police officer in charge of handling Mrs V.'s complaint of 13 February 2017 had not sought to obtain any further information apart from that contained in the written depositions of Mrs V. and her friend (see paragraph 19 above, and compare Tkhelidze v. Georgia, no. 33056/17, § 54, 8 July 2021).
