    ARMANI DA SILVA c. ROYAUME-UNI

    Auszug aus EGMR, 17.07.2018 - 15086/07
It can give rise to a finding of a separate and independent "interference" (see, with further references, Armani Da Silva v. the United Kingdom [GC], no. 5878/08, § 231, ECHR 2016).

As to the requirement that an investigation be carried out promptly and with reasonable expedition (see Armani Da Silva v. the United Kingdom [GC], no. 5878/08, § 240, ECHR 2016), we would like to point out that the criminal case was opened on the day of the killing.

    McKERR c. ROYAUME-UNI

    Auszug aus EGMR, 17.07.2018 - 15086/07
McKerr v. the United Kingdom, no. 28883/95, ECHR 2001-III; Kelly and Others v. the United Kingdom, no. 30054/96, 4 May 2001; Shanaghan v. the United Kingdom, no. 37715/97, 4 May 2001; and Hugh Jordan v. the United Kingdom, no. 24746/94, ECHR 2001-III (extracts).

    GONGADZE c. UKRAINE

    Auszug aus EGMR, 17.07.2018 - 15086/07
The domestic authorities" scrutiny in the case concerning a contract killing must aim to go beyond identification of a hitman and it is incumbent on the Court to satisfy itself that the investigation in the present case has addressed this important point (see, for example, Gongadze v. Ukraine, no. 34056/02, § 176, ECHR 2005-XI and Huseynova v. Azerbaijan, no. 10653/10, §§ 115-16, 13 April 2017).

    FINUCANE v. THE UNITED KINGDOM

    Auszug aus EGMR, 17.07.2018 - 15086/07
In Finucane v. the United Kingdom (no. 29178/95, ECHR 2003-VIII), a case where the applicant complained that the investigation into her husband's death was ineffective, in part because there were suspicions of collusion between the security forces and his killers, the Court held, inter alia, that "[i]n so far therefore as the investigation was conducted by RUC officers, they were part of the police force which was suspected by the applicant and other members of the community of issuing threats against [the applicant's husband]" and found that "there was a lack of independence attaching to this aspect of the investigative procedures, which also raises serious doubts as to the thoroughness or effectiveness with which the possibility of collusion was pursued" (ibid., § 76).

    HUSEYNOVA v. AZERBAIJAN

  • EGMR, 08.07.2021 - 33056/17

    TKHELIDZE v. GEORGIA

The Court reiterates that the obligation to protect life under Article 2 of the Convention requires that there be some form of effective official investigation when individuals have been killed either by State officials or private individuals (see Mazepa and Others v. Russia, no. 15086/07, § 69, 17 July 2018).
  • EGMR, 30.01.2024 - 34358/16

    AKHMEDNABIYEV AND KAMALOV v. RUSSIA

For a summary of the general principles reflecting the Court's approach to the examination of allegations of a violation of the procedural aspect of Article 2 of the Convention, see Mustafa Tunç and Fecire Tunç v. Turkey ([GC], no. 24014/05, §§ 169-82, 14 April 2015), and Mazepa and Others v. Russia (no. 15086/07, §§ 69-70 and 74, 17 July 2018).
  • EGMR, 07.11.2023 - 63543/09

    DURDAJ AND OTHERS v. ALBANIA

On the other hand, the national courts should not under any circumstances be prepared to allow life-endangering offences to go unpunished (see Mazepa and Others v. Russia, no. 15086/07, § 69, 17 July 2018, and RanÄ‘elovic and Others v. Montenegro, no. 66641/10, § 123, 19 September 2017; see also Öneryildiz, cited above, §§ 95-96).
  • EGMR, 07.02.2023 - 64937/19

    ELVAN c.

Turquie, no 25657/94, §§ 398-406, ECHR 2001-VII (extraits), Mazepa et autres c. Russie, no 15086/07, §§ 75-79, 17 juillet 2018, Ribcheva et autres c. Bulgarie, nos 37801/16 et 2 autres, §§ 125-130, 30 mars 2021 et Tkhelidze c. Géorgie, no 33056/17, §§ 58-59, 8 juillet 2021).
  • EGMR, 30.08.2022 - 46564/15

KORPORATIVNA TARGOVSKA BANKA AD v. BULGARIA

The Court cannot therefore re-examine those complaints (see Mazepa and Others v. Russia, no. 15086/07, §§ 61-62, 17 July 2018).
  • EGMR, 07.07.2022 - 72611/14

    TAGIYEVA v. AZERBAIJAN

In the present case, the Court observes that a number of relevant and timely investigative actions were carried out (see paragraphs 16-27 above) and it appears from the case file that the investigating authorities explored various possible motives behind the killing of the applicant's husband, including the possibility that it could have been linked to his publications (see paragraphs 25, 36 and 42 above) (contrast Huseynova, cited above, § 115, and Mazepa and Others v. Russia, no. 15086/07, §§ 77-78, 17 July 2018).
  • EGMR, 05.04.2022 - 71977/12

    NAGIBIN AND RYAZANTSEV v. RUSSIA

The Court dismisses the applicants' claim for costs and expenses because it has not been substantiated that the applicants paid them or were under a legally enforceable obligation to pay them (compare Mazepa and Others v. Russia, no. 15086/07, §§ 89-90, 17 July 2018; Radzevil v. Ukraine, no. 36600/09, §§ 94-96, 10 December 2019; Udaltsov v. Russia, no. 76695/11, § 201, 6 October 2020; and Aghdgomelashvili and Japaridze v. Georgia, no. 7224/11, § 61, 8 October 2020).
  • EGMR, 10.01.2019 - 65286/13

    KHADIJA ISMAYILOVA v. AZERBAIJAN

The Court has had to deal with a number of cases concerning respondent States" obligations to investigate criminal offences against journalists (see, for examples, Adali v. Turkey, no. 38187/97, § 231, 31 March 2005; Gongadze v. Ukraine, no. 34056/02, §§ 8-15 and 179, ECHR 2005-XI; Uzeyir Jafarov v. Azerbaijan, no. 54204/08, § 52, 29 January 2015; Huseynova v. Azerbaijan, no. 10653/10, § 115, 13 April 2017; and Mazepa and Others v. Russia, no. 15086/07, § 73, 17 July 2018).
  • EGMR, 22.03.2022 - 60844/11

    DAURBEKOV AND OTHERS v. RUSSIA

This is particularly striking given that the criminal proceedings has lasted for, at least, twelve years, which is in itself a strong indication of serious procedural defects (see Mazepa and Others v. Russia, no. 15086/07, § 80, 17 July 2018).
  • EGMR, 19.01.2023 - 32245/19

    MACHALIKASHVILI AND OTHERS v. GEORGIA

The specific requirements of the duty to investigate can be found in Mustafa Tunç and Fecire Tunç (cited above, §§ 169-82; see also Giuliani and Gaggio v. Italy [GC], no. 23458/02, §§ 298-306, ECHR 2011 (extracts), and Mazepa and Others v. Russia, no. 15086/07, §§ 69-70, 17 July 2018).
