Spanien , 9. Dezember 1994, Rdnr. 51, Serie A Band 303-C).
  • EGMR, 08.07.2003 - 36022/97

T. ./. Deutschland (Entsch.), Individualbeschwerde Nr. 47636/99, 4. Oktober 2001, und Burg u.a. ./. Frankreich (Entsch.), Individualbeschwerde Nr. 34763/02, ECHR 2003-II).

T. ./. Deutschland (Entsch.), Individualbeschwerde Nr. 47636/99, 4. Oktober 2001, und Burg u.a. ./. Frankreich (Entsch.), Individualbeschwerde Nr. 34763/02, ECHR 2003-II).
  • EGMR, 26.11.2015 - 3690/10

V../. Deutschland (Entsch.), Individualbeschwerde Nr. 65863/01, 5. Dezember 2002 und G. u. a../. Deutschland (Entsch.), Individualbeschwerde Nr. 18215/06, 12. Mai 2009).

Gondert ./. Deutschland - Begründungspflicht bei Nichtvorlage an den EuGH

Rn. 50 The Court further reiterates that for national superior courts - such as the Federal Constitutional Court - it is sufficient, when declining to admit a complaint for adjudication, simply to refer to the legal provisions governing the relevant procedure if the questions raised by the complaint are not of fundamental importance (see, among many other authorities, Teuschler v. Germany (dec.), no. 47636/99, 4 October 2001, and Greenpeace e.V. and Others v. Germany (dec.), no. 18215/06, 12 May 2009).
  • EGMR, 20.01.2015 - 16563/11

    ARRIBAS ANTON c. ESPAGNE

Allemagne (déc.), no 33681/96, 6 juillet 1999, Teuschler c. Allemagne (déc.), no 47636/99, 4 octobre 2001, Greenpeace E.V. et autres c. Allemagne (déc.), no 18215/06, 12 mai 2009, et John c. Allemagne (déc.), no 15073/03, 13 février 2007).

    DE SIMONE v. GERMANY

Rn. 37 The Court reiterates that for national superior courts - such as the Federal Constitutional Court - it is sufficient, when declining to admit a complaint, simply to refer to the legal provisions governing the relevant procedure if the questions raised by the complaint are not of fundamental importance (see, among many other authorities, Teuschler v. Germany (dec.), no. 47636/99, 4 October 2001, and Greenpeace e.V. and Others v. Germany (dec.), no. 18215/06, 12 May 2009).
  • EGMR, 11.10.2022 - 31612/09

    PAVLOV AND OTHERS v. RUSSIA

Are the judges in Strasbourg well placed to decide that the toxic effects of pollutants in the air of Lipetsk are thus more dangerous than those provoked by soot particles and respirable dust emissions in the heavy traffic areas of Hamburg, in respect of which the Court found no appearance of a violation of Article 8 (see Greenpeace E.V. and Others v. Germany (dec.), no. 18215/06, 12 May 2009)?.

  • EGMR, 07.05.2019 - 66498/17

    FRAILE ITURRALDE v. SPAIN

The Court reiterates that for national superior courts - such as the Constitutional Court - it suffices, when declining to admit a complaint, simply to refer to the legal provisions governing that procedure if the questions raised by the complaint are not of fundamental importance or if the appeal has no prospects of success (see Gorou v. Greece (no. 2) [GC], no. 12686/03, § 41, 20 March 2009; Arribas Antón, cited above, § 47; concerning the Federal Constitutional Court of Germany, see also Greenpeace E.V. and Others v. Germany (dec.), no. 18215/06, 12 May 2009; John v. Germany (dec.), no. 15073/03, 13 February 2007; and Teuschler v. Germany (dec.), no. 47636/99, 4 October 2001).

KUCZMA v. POLAND and 5 other applications

If the answer to question 8 is in the affirmative, did the State comply with its positive obligations under Article 8 to take all measures the authorities could reasonably be expected to take, in the light of the relevant provisions and principles, contained in the applicable EU law on ambient air quality, in order protect the applicants' rights to respect for their private and family life and home (see, mutatis mutandis, Pavlov and Others v. Russia, no. 31612/09, § 75, 11 October 2022, and Greenpeace E.V. and Others v. Germany (dec.), no. 18215/06, 19 May 2009)? Would the ambient air pollution complained of have been avoidable if the public authorities had put in place and enforced restrictions on the use of household and similar heaters and burners fuelled by coal derivatives?.

    LOGOS TREND D.O.O. v. SLOVENIA

The Court reiterates that for the national superior courts - such as the Constitutional Court - it suffices, when declining to admit or rejecting a complaint, simply to refer to the legal provisions governing that procedure if the questions raised by the complaint are not of fundamental importance (see, among many other authorities, Annen v. Germany, no. 3690/10, § 77, 26 November 2015, and Greenpeace e.V. and others v. Germany (dec.), no. 18215/06, 12 May 2009) or do not have any prospects of success (see Talmane v.
