On the other hand, the Court has consistently stressed that, to fall under Article 3, the suffering and humiliation involved must in any event go beyond that inevitable element of suffering or humiliation connected with a given form of legitimate treatment or punishment (see, mutatis mutandis, Tyrer v. the United Kingdom, judgment of 25 April 1978, Series A no. 26, p. 15, § 30, and Soering v. the United Kingdom, judgment of 7 July 1989, Series A no. 161, p. 39, § 100). - EGMR, 26.10.2000 - 30210/96

The State must ensure that given the practical demands of imprisonment, the health and well-being of a detainee are adequately secured by, among other things, providing him with the requisite medical assistance (see Kudla v. Poland [GC], no. 30210/96, §§ 93-94, ECHR 2000-XI; see also Hurtado v. Switzerland, judgment of 28 January 1994, Series A no. 280-A, opinion of the Commission, pp. - EGMR, 25.04.1978 - 5856/72

Nevertheless, where an applicant was released but subsequently re-detained, the Court limited the scope of its examination to the later period (see Belashev v. Russia, no. 28617/03, § 48, 4 December 2008; Grishin v. Russia, no. 30983/02, § 83, 15 November 2007; and Dvoynykh v. Ukraine, no. 72277/01, § 46, 12 October 2006).Grishin v. ALEKSANDR MAKAROV v. RUSSIA
Although there was no allegation of overcrowding beyond the design capacity or of a shortage of sleeping places (see, by contrast, Grishin v. Russia, no. 30983/02, § 89, 15 November 2007, and Kalashnikov v. Russia, no. 47095/99, § 97, ECHR 2002-VI), the conditions in the detention facility were nevertheless extremely cramped. It is also of particular concern for the Court that although a partition was installed between the living area and the lavatory pan, it did not offer privacy to a detainee using the toilet as he could still be seen by other inmates sitting on the bunks or by warders (compare with Grishin v. Russia, no. 30983/02, § 94, 15 November 2007).

It has therefore been lodged out of time and must be rejected in accordance with Article 35 §§ 1 and 4 of the Convention (see Grishin v. Russia, no. 30983/02, § 83, 15 November 2007). - EGMR, 09.10.2008 - 62936/00
MOISEYEV v. RUSSIA
Although there was no allegation of overcrowding beyond the design capacity or of a shortage of sleeping places (see, by contrast, Grishin v. Russia, no. 30983/02, § 89, 15 November 2007, and Kalashnikov v. Russia, no. 47095/99, § 97, ECHR 2002-VI), the conditions in the prison were nevertheless extremely cramped. - EGMR, 04.10.2016 - 2653/13
YAROSLAV BELOUSOV v. RUSSIA
It must be rejected in accordance with Article 35 §§ 1 and 4 of the Convention (see Grishin v. Russia, no 30983/02, § 83, 15 November 2007). - EGMR, 22.12.2008 - 46468/06
ALEKSANYAN v. RUSSIA
In the case of Grishin v. Russia the Court went further, holding that it was "prepared to accept that in principle the resources of medical facilities within the penitentiary system are limited compared to those of civil[ian] clinics" (no. 30983/02, § 76, 15 November 2007). - EGMR, 21.12.2010 - 3242/03
GLADKIY v. RUSSIA
In another case the Court went further, holding that it was "prepared to accept that in principle the resources of medical facilities within the penitentiary system are limited compared to those of civil[ian] clinics" (see Grishin v. Russia, no. 30983/02, § 76, 15 November 2007). - EGMR, 17.01.2012 - 43710/07
FETISOV AND OTHERS v. RUSSIA
Nevertheless, where an applicant was released but subsequently re-detained, the Court limited the scope of its examination to the later period (see Belashev v. BUTKO v. RUSSIA
The way the showering procedure was organised did not afford detainees even elementary privacy, since they were taken to shower halls as a group, and the number of functioning shower heads was occasionally too small to accommodate all of them (see Goroshchenya v. Russia, no. 38711/03, § 71, 22 April 2010; Shilbergs, cited above, § 97; Aleksandr Makarov, cited above, § 99; Seleznev v. Russia, no. 15591/03, § 44, 26 June 2008; Grishin v.
