ANDRASIK AND OTHERS v. SLOVAKIA
Auszug aus EGMR, 19.10.2004 - 67299/01
57984/00, 60237/00, 60242/00, 60679/00, 60680/00, 68563/01, 60226/00, 22 October 2002). - EGMR, 03.06.2004 - 45656/99
CATALDO v. ITALY
Auszug aus EGMR, 19.10.2004 - 67299/01
Only when these conditions are satisfied does the subsidiary nature of the protective mechanism of the Convention preclude examination of an application (see Cataldo v. Italy (dec.), no. 45656/99, 3 June 2004, with further references). - EKMR, 03.05.1988 - 12860/87
ANDERSEN v. DENMARK
Auszug aus EGMR, 19.10.2004 - 67299/01
The applicant's status as a victim then depends on whether the redress afforded at domestic level on the basis of the facts about which he complains before the Court (see Andersen v. Denmark, no. 12860/87, and Frederiksen and Others v. Denmark, no. 12719/87, Commission decisions of 3 May 1988, unreported; Normann v. Denmark (dec.), no. 44704/98, 14 June 2001; and Jensen and Rasmussen v. Denmark (dec.), no. 52620/99, 20 March 2003) was adequate and sufficient having regard to just satisfaction as provided for under Article 41 of the Convention.

FREDERIKSEN c. DANEMARK
Auszug aus EGMR, 19.10.2004 - 67299/01
The applicant's status as a victim then depends on whether the redress afforded at domestic level on the basis of the facts about which he complains before the Court (see Andersen v. SIRANCOVA v. SLOVAKIA
Auszug aus EGMR, 19.10.2004 - 67299/01
In the light of all the material in its possession, including the promptness of the findings and award made by the Constitutional Court in the present case, the Court considers that the sum accorded to the applicant cannot be considered as unreasonable (see Cataldo, cited above, Širancová v. Slovakia (dec.), no. 62216/00, 7 September 2004, Eštok v. Slovakia (dec.), no. 63994/00, 28 September 2004 and, a contrario, Scordino v. Italy (dec.), no. 36813/97, 27 March 2003). - EGMR, 28.09.2004 - 63994/00
ESTOK v.
- EGMR, 11.10.2005 - 52690/99
MAJEWSKI v. POLAND
However, it took into account the state of the proceedings at that time and found a violation of the applicant's right to a hearing without unjustified delay (see Dubjakova v. Slovakia, (dec), no 67299/01, 19 October 2004). - EGMR, 28.10.2014 - 15048/09
ASLAN AND ASLAN v. TURKEY
- EGMR, 17.12.2009 - 20075/03
SHILBERGS v. RUSSIA
These include also the value of the award judged in the light of the ordinary living standards and the general level of incomes in the State concerned and the fact that the remedy in the national system is closer and more accessible than an application to the Court (see Scordino, cited above, §§ 206 and 268, and Dubjaková v. Slovakia (dec.), no. 67299/01, 19 October 2004, with further references).
- EGMR, 29.03.2006 - 64897/01
ERNESTINA ZULLO c. ITALIE
The Court can also perfectly well accept that a State which has introduced a number of remedies, one of which is designed to expedite proceedings and one to afford compensation, will award amounts which - while being lower than those awarded by the Court - are not unreasonable, on condition that the relevant decisions, which must be consonant with the legal tradition and the standard of living in the country concerned, are speedy, reasoned and executed very quickly (see Dubjakova v. Slovakia (dec.), no. 67299/01, 10 October 2004). - EGMR, 29.03.2006 - 64886/01
COCCHIARELLA v. ITALY
Slovaquie (déc.), no 67299/01, 19 octobre 2004). - EGMR, 29.03.2006 - 65075/01
GIUSEPPINA AND ORESTINA PROCACCINI v. ITALY
Slovaquie (déc.), no 67299/01, 10 octobre 2004). - EGMR, 03.06.2025 - 20641/20
SELIMI v. SERBIA and 16 other applications
Rn. 193 The applicants' victim status then depends on whether the redress afforded was adequate and sufficient having regard to just satisfaction as provided for under Article 41 of the Convention (see, for example, Dubjaková v. Slovakia (dec.), no. 67299/01, 19 October 2004, and Vidaković, cited above § 28). - EGMR, 25.03.2025 - 40410/07
KOSTIC v. SERBIA
Where the national authorities have acknowledged, either expressly or in substance, the alleged infringements, and if necessary, provided adequate and sufficient redress in respect of the facts complained of, the subsidiary nature of the protective mechanism of the Convention precludes examination of an application or a complaint, as the party concerned can no longer claim to be a victim within the meaning of Article 34 of the Convention in relation thereto (see, among other authorities, Cocchiarella, cited above, § 71; Dubjaková v. Slovakia (dec.), no. 67299/01, 19 October 2004, and Albayrak v. Turkey, no. 38406/97, § 32, 31 January 2008). - EGMR, 29.03.2006 - 62361/00
RICCARDI PIZZATI c.
- EGMR, 29.03.2006 - 65102/01
GIUSEPPE MOSTACCIUOLO v. ITALY (No. 2)
