    The majority's emphasis on his not having involved himself in the public debate on this topic appears very consonant with the European Court of Human Rights' reasoning in its judgment of 25 November 1999 in Nilsen and Johnsen v. Norway (no. 23118/93), § 52, first sub-paragraph, with its emphasis on Bratholm's 'participation in public debate' as the central theme.

    The Court finds that some pecuniary loss must have been occasioned by reason of the periods that elapsed from the time when the various sums were paid and the costs incurred until the Court's present award of just satisfaction (see, for example, Bladet Tromsø and Stensaas, cited above, § 83; Nilsen and Johnsen v. Norway [GC], no. 23118/93, § 65, ECHR 1999-VIII; and Bergens Tidende and Others, cited above, § 70).

EGMR, - 4. Sektion -, Urteil vom 16. November 2004, Beschwerde-Nr. 53678/00, Karhuvaara und Iltalehti gegen Finnland, § 40; EGMR, - 1. Sektion -, Urteil vom 1. März 2007, Beschwerde-Nr. 510/04, Tønsbergs Blad u.a. gegen Norwegen, § 82).

    Ein von Art. 10 EMRK gewährleisteter Beitrag von allgemeinem Interesse kann nach der Rechtsprechung des Gerichtshofs insbesondere in der Ermöglichung öffentlicher Kontrolle auch des privaten Gebarens einflussreicher Personen etwa des Wirtschaftslebens, der Kultur oder des Journalismus bestehen (vgl. EGMR, - 1. Sektion -, Urteil vom 1. März 2007, Beschwerde-Nr. 510/04, Tønsbergs Blad u.a. gegen Norwegen, § 87 f.; EGMR, - 1. Sektion -, Urteil vom 14. Dezember 2006, Beschwerde-Nr. 10520/02, Verlagsgruppe News GmbH gegen Österreich, § 35 ff.; EGMR, - 4. Sektion -, Beschluss vom 14. Juni 2005, Beschwerde-Nr. 14991/02, Minelli gegen Schweiz).

    Wird seitens der nationalen Gerichte ein zu restriktiver Maßstab daran angelegt, ob die Medienberichterstattung über Umstände aus dem Privatleben einer außerhalb des staatlichen und politischen Lebens stehenden Person die Behandlung von Fragen allgemeinen Interesses erkennen lässt, hat der Gerichtshof dies beanstandet (vgl. EGMR, - 1. Sektion -, Urteil vom 1. März 2007, Beschwerde-Nr. 510/04, Tønsbergs Blad u.a. gegen Norwegen, § 87).
