In determining whether the District Court could be considered "independent and impartial", the Court will have regard to the principles established in its own case-law (see, for instance, the above-mentioned Langborger judgment, Series A no. 155, p. 16, para. 32; and the Fey v. Austria judgment of 24 February 1993, Series A no. 255-A, p. 12, paras. 27, 28 and 30), which apply to jurors as they do to professional judges and lay judges.

It should be reiterated that the principles established in the Court's case-law apply to jurors as they do to professional judges and lay judges (see Holm v. Sweden, judgment of 25 November 1993, Series A no. 279-A, p. 14, § 30; and Pullar v. the United Kingdom, judgment of 10 June 1996, Reports of Judgments and Decisions 1996-III, p. 792, § 29).The rules in the Administration of Court Act governing the impartiality of judges also applied to jurors (see Holm v. Sweden, judgment of 25 November 1993, Series A no. 279-A, p. 15, § 31).

Furthermore, these principles apply equally to each juror as the sole arbiters of fact (Eur. Pour ce qui est de l'absence de qualification juridique des membres ordinaires, la Cour rappelle que le fait que des magistrats non professionnels siègent dans un tribunal n'est pas en soi contraire à l'article 6. S'agissant du grief des requérants concernant le manque de formation juridique des membres de la Haute Cour qui étaient des officiers de carrière, la Cour rappelle que la participation de juges non professionnels dans les tribunaux n'est pas, en tant que telle, contraire à l'article 6 de la Convention: les principes établis par sa jurisprudence relative à l'indépendance et à l'impartialité valent pour les magistrats professionnels comme pour les magistrats non professionnels (Langborger c. Suède, 22 juin 1989, § 32, série A no 155, Fey c. Autriche, 24 février 1993, § 27, série A no 255-A, Holm c.
