ARTUN ET GÜVENER c. TURQUIE
Turquie, no 44104/98, § 24, 1er mars 2005). - EGMR, 19.11.2019 - 9662/10
YURTDAS ET SÖYLEMEZ c. TURQUIE
Turquie, no 48979/10, § 17, 17 avril 2018). - EGMR, 01.10.2019 - 62928/12
ARAMAZ v. TURKEY
Espagne, no 39293/98, § 46, 29 février 2000, et Birol c. Turquie, no 44104/98, § 30, 1er mars 2005).

ÖNER AND TÜRK v. TURKEY
Auszug aus EGMR, 25.09.2018 - 2433/12
The Court notes at the outset that it has already examined and dismissed an identical objection regarding the rule of exhaustion of domestic remedies by the respondent Government (see Öner and Türk v. Turkey, no. 51962/12, §§ 14-18, 31 March 2015).As regards the necessity of the interference in a democratic society, the Court notes that it has already examined similar grievances in a number of cases and found violations of Articles 10 and 11 of the Convention (see, for example, Savgın v. Turkey, no. 13304/03, §§ 39-48, 2 February 2010; Gül and Others v. Turkey, no. 4870/02, §§ 32-45, 8 June 2010; Menteş v. Turkey (no. 2), no. 33347/04, §§ 39-54, 25 January 2011; Kılıç and Eren v. The Court is also prepared to accept that, in the present case, the national authorities may be considered to have pursued the legitimate aims of protecting national security and preventing disorder and crime (see Faruk Temel v. Turkey, no. 16853/05, § 52, 1 February 2011). - EGMR, 06.12.2016 - 50171/09

2433/12. - EGMR, 11.02.2020 - 69270/12
ÖZER v. TURKEY
Turquie, no 30007/96, § 35, 11 janvier 2005, Menteş c. Turquie (no 2), no 33347/04, § 51, 25 janvier 2011, Fatih Taş c. Turquie (no 4), no 51511/08, § 38, 24 avril 2018, Mart et autres c. BAKIR v. TURKEY
The Court reiterates that it has previously examined complaints relating to issues that were similar to those in the present case and has found a violation of Article 10 of the Convention (see Kılıç and Eren v. Turkey, no. 43807/07, §§ 20-31, 29 November 2011; Gül and Others, cited above, §§ 32-45; Bahçeci and Turan v. Turkey, no. 33340/03, §§ 24-34, 16 June 2009; and in particular Belge v. Turkey, no. 50171/09, §§ 17 and 35, 6 December 2016, and Varhan v. Turkey ([Committee], no. 2433/12, §§ 16-24, 25 September 2018), where the Court found a violation on account of the applicant's conviction for disseminating propaganda on the basis of waving a green, yellow and red flag symbolising the PKK and chanting slogans).
