  • EGMR, 21.02.1990 - 11855/85
    Auszug aus EGMR, 08.02.2005 - 55853/00
Turning to the particular circumstances of the present case, the Court observes from the outset that there can be no question of the applicant having waived any right to a hearing under Article 6 § 1 of the Convention (cf, Håkansson and Sturesson v. Sweden, judgment of 21 February 1990, Series A no. 171-A, p. 20, §§ 64 and 66; and Schuler-Zgraggen v. Switzerland, judgment of 24 June 1993, Series A no. 263, pp. 19-20, § 58).

Under Article 6 § 1 and its interpretation in the case-law of the Court there is a general entitlement to an oral hearing unless exceptional circumstances justify dispensing with such a hearing (Håkansson and Sturesson v. Sweden, judgment of 21 February 1990, Series A no. 171-A, p. 20, § 64, or more recently, Göç v. Turkey (GC), no. 36590/97, §§ 47-52 ECHR 2002-V).

    SCHULER-ZGRAGGEN c. SUISSE

The case is close to that of Schuler-Zgraggen v. Switzerland (judgment of 24 June 1993, Series A no. 263), which also concerned a disability pension.

    Auszug aus EGMR, 08.02.2005 - 55853/00
Regard must be had to the nature of the national appeal system, to the scope of the appellate court's powers and to the manner in which the applicant's interests are actually presented and protected in the appeal, particularly in the light of the nature of the issues to be decided by it, and whether these raise any questions of fact or questions of law which cannot be adequately resolved on the basis of the case-file (see for instance Helmers v. Sweden, judgment of 29 October 1991, Series A no. 212-A, p. 16, § 36).

    FREDIN c. SUÈDE (N° 2)

    Auszug aus EGMR, 08.02.2005 - 55853/00
The Court reiterates that in proceedings before a court of first and only instance the right to a "public hearing" under Article 6 § 1 entails an entitlement to an "oral hearing" unless there are exceptional circumstances that justify dispensing with such a hearing (see, for instance, Fredin v. Sweden (no. 2), judgment of 23 February 1994, Series A no. 283-A, pp.

    599. When carrying out its assessment, the Court needs to establish whether the applicant's claim was frivolous or vexatious or otherwise lacking in foundation (see, for instance, Miller v. Sweden, no. 55853/00, § 28, 8 February 2005).
  • BVerfG, 30.06.2014 - 2 BvR 792/11

EGMR, Axen v. Germany, Urteil vom 8. Dezember 1983, Nr. 8273/78, EGMR-E 2, 321 , § 28; Bulut v. Austria, Urteil vom 22. Februar 1996, Nr. 17358/90, § 41 f.; Hoppe v. Germany, Urteil vom 5. Dezember 2002, Nr. 28422/95, § 63 f.; Miller v. Sweden, Urteil vom 8. Februar 2005, Nr. 55853/00, § 30).

Dies bedeutet nicht, dass die Ablehnung, eine mündliche Verhandlung durchzuführen, nur in seltenen Fällen gerechtfertigt sein kann (siehe Miller./. Schweden, Individualbeschwerde Nr. 55853/00, Rdnr. 29, 8. Februar 2005).
