    Es kann offenbleiben, ob ein "offenkundiger Mangel" der Verteidigung im Sinne der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte (Urteile vom 10. Oktober 2002 - 38830/97 - Czekalla/Portugal Tz. 59 ff. und vom 22. März 2007 - 59519/00 - Staroszczyk/Polen Tz. 122, 133) darin zu sehen sein könnte, dass der Pflichtverteidiger nach seiner erneuten Bestellung das Rechtsmittel nicht innerhalb der noch laufenden Monatsfrist begründet hat.

    Etwaige Versäumnisse eines Pflichtverteidigers können dem Staat nur ausnahmsweise angelastet werden, da die Führung der Verteidigung Sache des Angeklagten und seines Pflicht- oder Wahlverteidigers ist (EGMR, Urteil vom 22. März 2007 - 59519/00 - Staroszczyk/Polen Tz. 133).

    Für Behörden und Gerichte besteht eine Verpflichtung zum Eingreifen nur, wenn das Versagen eines Pflichtverteidigers für die Justiz offenkundig ist oder sie davon unterrichtet wird (EGMR, Urteile vom 10.
