    Auszug aus EGMR, 02.10.2012 - 2594/07
    The Court has repeatedly stressed the pre-eminent role of the press in a democratic State governed by the rule of law (see the Castells v. Spain, 23 April 1992, § 43, Series A no. 236; Thorgeir Thorgeirson v. Iceland, 25 June 1992, § 63, Series A no. 239; Goodwin v. the United Kingdom, 27 March 1996, § 39, Reports 1996-II; Jersild v. Denmark, 23 September 1994, § 31, Series A no. 298; and Fatullayev v. Azerbaijan, no. 40984/07, § 88, 22 April 2010).
  • EGMR, 26.11.1991 - 13585/88

Were it otherwise, the press would be unable to play its vital role of "public watchdog" (see, among other authorities, Observer and Guardian v. the United Kingdom, 26 November 1991, § 59, Series A no. 216, and The Sunday Times v. the United Kingdom (no. 2), 26 November 1991, § 50, Series A no. 217).

    Auszug aus EGMR, 02.10.2012 - 2594/07
The Court notes that the applicant lodged a civil claim complaining, inter alia, of a violation of his rights under Article 10 of the Convention (see § 22 above and, a contrario, Rizvanov v. Azerbaijan, no. 31805/06, § 73, 17 April 2012).

    Auszug aus EGMR, 02.10.2012 - 2594/07
The Court notes that public measures preventing journalists from doing their work may raise issues under Article 10 (see, mutatis mutandis, Gsell v. Switzerland, no. 12675/05, § 49 et seq., 8 October 2009).

    Auszug aus EGMR, 02.10.2012 - 2594/07
Ill-treatment must attain a minimum level of severity if it is to fall within the scope of Article 3. Assessment of this minimum level depends on all the circumstances of the case, such as the duration of the treatment, its physical or mental effects and, in some cases, the sex, age and state of health of the victim (see Ireland v. the United Kingdom, 18 January 1978, § 162, Series A no. 25; Kudla v. Poland [GC], no. 30210/96, § 91, ECHR 2000-XI; and Peers v. Greece, no. 28524/95, § 67, ECHR 2001-III).

    Auszug aus EGMR, 02.10.2012 - 2594/07

  • EGMR, 04.05.2001 - 28883/95
    Auszug aus EGMR, 02.10.2012 - 2594/07
The Court is sensitive to the subsidiary nature of its role and recognises that it must be cautious in taking on the role of a first-instance tribunal of fact, where this is not rendered unavoidable by the circumstances of a particular case (see, for example, McKerr v. the United Kingdom (dec.), no. 28883/95, 4 April 2000).

    PENTIKÄINEN v. FINLAND

La situation de l'intéressé est donc différente de celle du requérant dans l'affaire Najafli c. Azerbaïdjan, lequel avait porté sa carte de presse sur le buste et avait expressément indiqué aux agents de police qu'il était journaliste (voir Najafli c. Azerbaïdjan, no 2594/07, § 67, 2 octobre 2012, et, mutatis mutandis, Gsell c. Suisse, précité, § 49).
  • EGMR, 08.09.2026 - 64510/17
The Court attaches particular importance also to the type of injuries sustained and the circumstances in which force was used (see Timtik, cited above, § 49; Najafli v. Azerbaijan, no. 2594/07, § 38, 2 October 2012; Şakir Kaçmaz, cited above, § 80; and Gevorgyan v. Armenia, no. 231/16, § 53, 22 May 2025).
  • EGMR, 06.10.2015 - 60659/08

KHALIL v. AZERBAIJAN and 2 other applications

Having regard to the Court's position with respect to affording just satisfaction to the injured party in similar cases (see, inter alia, Najafli v. Azerbaijan, Application no. 2594/07, Judgment of 2 October 2012; Rizvanov v. Azerbaijan, Application no. 31805/06, Judgment of 17 April 2012), the Government are ready to pay to the applicant a total sum of EUR 25, 000 (twenty-five thousand euros), including EUR 3, 000 (three thousand euros) as the compensation for costs and expenses, plus any tax may be chargeable on this amount.

The Court further observes that there is already well-established case-law of the Court, including regarding Azerbaijan, concerning the main complaints raised by the applicant in his applications (see, for instance, Emin Huseynov v. Azerbaijan, no. 59135/09, §§ 49-88, 7 May 2015; Uzeyir Jafarov v. Azerbaijan, no. 54204/08, §§ 37-72, 29 January 2015; Najafli v. Azerbaijan, no. 2594/07, §§ 30-70, 2 October 2012; and Rizvanov v. Azerbaijan, no. 31805/06, §§ 32-61, 17 April 2012).
