In that context it has held that although individual interests must on occasion be subordinated to those of a group, democracy does not simply mean that the views of the majority must always prevail: a balance must be achieved that ensures the fair and proper treatment of minorities and avoids any abuse of a dominant position (see Chassagnou and Others v. France [GC], nos. 25088/94 and 2 others, § 112, ECHR 1999-III; S.A.S. v. France [GC], no. 43835/11, § 128, ECHR 2014 (extracts); and Bączkowski and Others, cited above, §§ 61 and 63, with further references). - EGMR, 04.12.2008 - 30562/04

Such elements as a person's sexual orientation and sexual life fall within the personal sphere protected by Article 8 (see, among other authorities, S. and Marper v. the United Kingdom [GC], nos. 30562/04 and 30566/04, § 66, ECHR 2008; for a broader context see also Van Kück v. Germany, no. 35968/97, § 78, 12 June 2003, on sexual self-determination constituting one of the aspects of a person's right to respect for his private life). - EGMR, 13.11.2007 - 57325/00

The Court has established in its case-law that discrimination means treating differently, without an objective and reasonable justification, persons in relevantly similar situations (see, among many authorities, D.H. and Others v. the Czech Republic [GC], no. 57325/00, § 175, ECHR 2007-IV, see also Molla Sali v. Greece [GC], no. 20452/14, § 135, 19 December 2018).

In this regard, the Court notes that in cases involving complaints under Article 13, based on such allegations of discriminatory attitudes affecting the effectiveness of remedies in the application of generally applicable national laws, the Court has usually not considered it necessary to separately examine the complaints under that provision if a violation of Article 14, taken together with other Convention provisions, has already been found (see, in particular, Opuz v. Turkey, no. 33401/02, § 205, ECHR 2009). - EGMR, 02.02.2016 - 22947/13

The Court had likewise recognised that the "potential impact of the medium concerned was an important factor" (the Government referred to Magyar Tartalomszolgáltatók Egyesülete and Index.hu Zrt v. Hungary, no. 22947/13, § 56, 2 February 2016). - EGMR, 25.09.2018 - 76639/11
Denisov v. Ukraine
Auszug aus EGMR, 14.01.2020 - 41288/15
In order for Article 8 to come into play, however, an attack on a person must attain a certain level of seriousness and be made in a manner causing prejudice to the personal enjoyment of the right to respect for one's private life (see, mutatis mutandis, Delfi, cited above, § 137, with further references; also see, on the importance of analysis of the seriousness of the impugned interference for Article 8 to come into play in the context of different types of cases, Denisov v. Ukraine [GC], no. 76639/11, §§ 110-14, 25 September 2018). - EGMR, 20.06.2017 - 67667/09

In the present case, although the Klaipėda District Court cited the alleged incompatibility between maintaining family values as the foundation of society and acknowledging the social acceptance of homosexuality, the Court sees no reason to consider those elements as incompatible, especially in view of the growing general tendency to view relationships between same-sex couples as falling within the concept of "family life" (see Bayev and Others v. Russia, nos. 67667/09 and 2 others, § 67, 20 June 2017). - EGMR, 26.10.2017 - 28475/12

Differences based solely on considerations of sexual orientation are unacceptable under the Convention (see, more recently, Ratzenböck and Seydl v. Austria, no. 28475/12, § 32, 26 October 2017, and the case-law cited therein). - EGMR, 08.07.2019 - 54012/10
MIHALACHE v. ROMANIA

The Court has also held that the provisions of the Convention must be interpreted and applied in a manner which renders their safeguards practical and effective, not theoretical and illusory (see, more recently, Mihalache v. Romania [GC], no. 54012/10, § 91, 8 July 2019). - EGMR, 09.02.2012 - 1813/07

WA BAILE c. SUISSE
Suisse, no 14065/15, § 54, 19 janvier 2021, Glor c. Suisse, no 13444/04, § 52, CEDH 2009, Mikulić c. Croatie, no 53176/99, § 53, CEDH 2002-I, et Beizaras et Levickas c. Lacatus ./. Schweiz - Bettelverbot unverhältnismäßig
Souvent mentionnée sur le terrain de l'article 3, cette notion a également été évoquée à plusieurs reprises par la Cour sous l'angle de l'article 8 (voir notamment, Kučera c. Slovaquie, no 48666/99, § 122, 17 juillet 2007 ; Rachwalski et Ferenc c. Pologne, no 47709/99, § 73, 28 juillet 2009 ; El-Masri c. l'ex-République yougoslave de Macédoine [GC], no 39630/09, § 248, CEDH 2012 ; Khadija Ismayilova c. Azerbaïdjan, nos 65286/13 et 57270/14, § 116, 10 janvier 2019 ; Beizaras et Levickas c. Lituanie, no 41288/15, § 117, 14 janvier 2020 ; Vinks et Ribicka c. Lettonie, no 28926/10, § 114, 30 janvier 2020, et Hudorovič et autres c. Slovénie, nos 24816/14 et 25140/14, § 116, 10 mars 2020). - EGMR, 23.01.2023 - 61435/19

The results of similar surveys dating from 2012 and 2015 have been summarised in Beizaras and Levickas v. Lithuania (no. 41288/15, §§ 63-64, 14 January 2020).In addition, following the Court's judgment in Beizaras and Levickas v. Lithuania (no. 41288/15, 14 January 2020), there had been an important shift in the practice of the domestic authorities, which were now taking all necessary measures to investigate allegations of hate speech on the grounds of sexual orientation.

It would be incompatible with the underlying values of the Convention, as an instrument of the European public order, if the exercise of Convention rights by a minority group were made conditional on its being accepted by the majority (see, mutatis mutandis, Alekseyev, cited above, § 81; Bayev and Others v. Russia, nos. 67667/09 and 2 others, § 70, 20 June 2017; and Beizaras and Levickas v. Lithuania, no. 41288/15, § 122, 14 January 2020). - Generalanwalt beim EuGH, 05.06.2025 - C-769/22

F.O. v. CROATIA
In order for Article 8 to come into play, however, an attack on a person must attain a certain level of seriousness and be made in a manner causing prejudice to the personal enjoyment of the right to respect for one's private life (see Beizaras and Levickas v. Lithuania, no. 41288/15, § 109 in fine, 14 January 2020).In order for Article 8 to come into effect, an attack on a person must attain a certain level of seriousness and be made in a manner causing prejudice to the personal enjoyment of the right to respect for one's private life (see Beizaras and Levickas v. Lithuania, no. 41288/15, § 109 in fine, 14 January 2020).
I regret not to be able to agree with the majority of the Court that the treatment complained of by the applicant was in itself serious enough to give rise to an issue under Article 8 of the Convention (see Beizaras and Levickas v. Lithuania, no. 41288/15, § 109, 14 January 2020).
- EGMR, 17.01.2023 - 39375/19
VALAITIS v. LITHUANIA
The Prosecutor General's Office underscored that all the above "principle aspects" (principiniai aspektai) had been mentioned in the Supreme Court's practice (rulings in cases nos. 2K-677/2012 and 2K-86-648/2016), and that those two Supreme Court rulings had been referred to by the Court in the judgment of Beizaras and Levickas (no. 41288/15, 14 January 2020), in which the Court had expressed its disquiet with such a practice on the part of the Supreme Court.Having regard to the Court's conclusions in Beizaras and Levickas (no. 41288/15, 14 January 2020), the Government did not question the applicability of Article 13 of the Convention to the circumstances of the present case, leaving the matter to the Court for a final decision.
In my opinion, the judgment embarks on a review of the execution of the judgment given in Beizaras and Levickas v. Lithuania (no. 41288/15, 14 January 2020) rather than dealing with the specific case of the applicant whose complaint was before the Court.
- EGMR, 06.10.2026 - 42160/21 In order for Article 8 to come into play, however, an attack on a person must attain a certain level of seriousness and be made in a manner causing prejudice to the personal enjoyment of the right to respect for one's private life (see Beizaras and Levickas v. Lithuania, no. 41288/15, § 109 in fine, 14 January 2020).

ASSOCIATION ACCEPT AND OTHERS v. ROMANIA
Such elements as a person's sexual orientation and sexual life fall within the personal sphere protected by Article 8. In certain areas of private life (such as environmental issues and the right to reputation), in order for Article 8 to come into play, the Court considers that the alleged violation must attain a certain level of seriousness and be committed in a manner causing prejudice to the personal enjoyment of the right to respect for one's private life (see Beizaras and Levickas v. Lithuania, no. 41288/15, § 109, 14 January 2020; also see, on the importance of analysis of the seriousness of the impugned interference for Article 8 to come into play in the context of different types of cases, Denisov, cited above, § 110-114).In the context of hate speech, the Court has acknowledged that criminal sanctions, including against the individuals responsible for the most serious expressions of hatred, inciting others to violence, could be invoked only as an ultima ratio measure (see Beizaras and Levickas v. Lithuania, no. 41288/15, § 111, 14 January 2020).
