  • EGMR, 06.03.2001 - 45276/99

Tansania, CUF, Civic United Front, Oppositionelle, Inhaftierung, Folter, …

    Auszug aus EGMR, 28.06.2011 - 8319/07
Article 35 must also be applied to reflect the practical realities of the applicant's position in order to ensure the effective protection of the rights and freedoms guaranteed by the Convention (Hilal v. the United Kingdom (dec.), no. 45276/99, 8 February 2000).

These standards imply that the ill-treatment the applicant alleges he will face if returned must attain a minimum level of severity if it is to fall within the scope of Article 3. The assessment of this is relative, depending on all the circumstances of the case (Hilal v. the United Kingdom, no. 45276/99, § 60, ECHR 2001-II).

The Court recalls that Article 3 does not, as such, preclude Contracting States from placing reliance on the existence of an internal flight alternative in their assessment of an individual's claim that a return to his country of origin would expose him to a real risk of being subjected to treatment proscribed by that provision (Salah Sheekh v. the Netherlands, no. 1948/04, § 141, ECHR 2007-I (extracts), Chahal v. the United Kingdom, 15 November 1996, § 98, Reports of Judgments and Decisions 1996-V and Hilal v. the United Kingdom, no. 45276/99, §§ 67 - 68, ECHR 2001-II).

  • EGMR, 11.01.2007 - 1948/04

    Somalia, Abschiebungshindernis, zielstaatsbezogene Abschiebungshindernisse, …

    Auszug aus EGMR, 28.06.2011 - 8319/07
Equally, an applicant cannot be regarded as having failed to exhaust domestic remedies if he or she can show, by providing relevant domestic case-law or any other suitable evidence, that an available remedy which he or she has not used was bound to fail (Kleyn and Others v. the Netherlands [GC], nos. 39343/98, 39651/98, 43147/98 and 46664/99, § 156, ECHR 2003-VI; Salah Sheekh v. the Netherlands, no. 1948/04, §§ 121 et seq., ECHR 2007-... (extracts)).

  • EGMR, 17.07.2008 - 25904/07

Sri Lanka, Tamilen, Europäischer Menschenrechtsgerichtshof, menschenrechtswidrige …

    Auszug aus EGMR, 28.06.2011 - 8319/07
    v. the United Kingdom, no. 25904/07, § 95, 17 July 2008).

    v. the United Kingdom, no. 25904/07, §§ 118 - 122, 17 July 2008, little or no weight should be attached to the report of the fact-finding mission as it did not visit Somalia, did not appear to contact anyone in Somalia, and the majority of "sources" were anonymous, identified only as "an international NGO", "a diplomatic source", or "security advisors".

  • EGMR, 28.05.1985 - 9214/80
    Auszug aus EGMR, 28.06.2011 - 8319/07
It is settled case-law that Contracting States have the right as a matter of international law and subject to their treaty obligations, including the Convention, to control the entry, residence and expulsion of aliens (Üner v. the Netherlands [GC], no. 46410/99, § 54, ECHR 2006-....; Abdulaziz, Cabales and Balkandali v. the United Kingdom, judgment of 28 May 1985, Series A no. 94, p. 34, § 67, Boujlifa v. France, judgment of 21 October 1997, Reports 1997-VI, p. 2264, § 42).
  • EGMR, 27.05.2008 - 26565/05

    N. ./. Vereinigtes Königreich

    Auszug aus EGMR, 28.06.2011 - 8319/07
Insofar as the applicants were relying on the "dire" humanitarian conditions in Somalia as creating the risk of ill-treatment contrary to Article 3 of the Convention, the Government submitted that the principles established in N. v. the United Kingdom [GC], no. 26565/05, §§ 42 - 45, 27 May 2008 were applicable.
  • EGMR, 30.10.1991 - 13163/87
    Auszug aus EGMR, 28.06.2011 - 8319/07
This in turn must be considered in the light of the general situation there as well as the applicant's personal circumstances (Vilvarajah and Others v. the United Kingdom, judgment of 30 October 1991, Series A no. 215, § 108).
  • EGMR, 07.03.2000 - 43844/98

Dubliner Übereinkommen, Dublinverfahren, Großbritannien, Sri Lanka, sichere …

    Auszug aus EGMR, 28.06.2011 - 8319/07
However, the Court has held that reliance on an internal flight alternative does not affect the responsibility of the expelling Contracting State to ensure that the applicant is not, as a result of its decision to expel, exposed to treatment contrary to Article 3 of the Convention (Salah Sheekh v. the Netherlands, cited above, § 141 and T.I. v. the United Kingdom (dec.), no. 43844/98, ECHR 2000-III).
  • EGMR, 06.05.2003 - 39343/98

KLEYN AND OTHERS v. THE NETHERLANDS

  • EGMR, 16.12.1999 - 24724/94

    Mord an James Bulger

    Auszug aus EGMR, 28.06.2011 - 8319/07
The burden of proof is on the Government claiming non-exhaustion to satisfy the Court that an effective remedy was available in theory and in practice at the relevant time, namely, that the remedy was accessible, capable of providing redress in respect of the applicant's complaints and offered reasonable prospects of success (see T. v. the United Kingdom [GC], no. 24724/94, 16 December 1999, § 55).
  • EGMR, 24.01.2008 - 29787/03

    29787/03 and 29810/03, ECHR 2008-... (extracts) and Al-Agha v. Romania, no. 40933/02, 12 January 2010).

  • VGH Baden-Württemberg, 17.12.2020 - A 11 S 2042/20

VGH Bad.-Württ., Urteile vom 29.10.2019 - A 11 S 1203/19 -, juris Rn. 96 , vom 26.06.2019 - A 11 S 2108/18 -, juris Rn. 26 , …und vom 24.07.2013 - A 11 S 697/13 -, Leitsatz 5 sowie insbesondere auch juris Rn. 79 ff.;… Bay. A 11 S 1203/19 -, juris Rn. 99 , vom 26.06.2019 - A 11 S 2108/18 -, juris Rn. 36 ff.; vgl. Die tatsächliche Gefahr einer Art. 3 EMRK zuwiderlaufenden Behandlung muss aufgrund aller Umstände des Falles hinreichend sicher und darf nicht hypothetisch sein (EGMR, Urteile vom 28.06.2011 - 8319/07 und 11449/07 -, Rn. 212 ff., vom 27.05.2008 - 26565/05 - , Rn. 34 ff., …und vom 06.02.2011 - 44599/98 -, Rn. 36 ff.; vgl. auch OVG NRW…, Urteil vom 18.06.2019 - 13 A 3930/18.A -, juris Rn. 43; Nds. • VGH Baden-Württemberg, 22.02.2023 - A 11 S 1329/20

The Government also emphasised that the applicant had been granted temporary protection in Denmark on account of the general situation in his home country, which could change quite quickly (see for example, Sufi and Elmi v. the United Kingdom, nos. 8319/07 and 11449/07, 28 June 2011, and K.A.B. v. Sweden, no. 886/11, 5 September 2013, as regards the situation in Mogadishu, Somalia).

Moreover, an improvement in the situation is not just theoretical, as witness the situation in Somalia (see Sufi and Elmi v. the UK, nos. 8319/07 and 11449/07, 28 June 2011, and K.A.B. v. Sweden, no. 886/11, 5 September 2013) 14. Article 8 cannot be construed as requiring an alignment of all refugee statuses, whether under the "primary" head of migration or the "subsidiary" head of family reunification.
