BAYRAM and YILDIRIM v. TURKEY
Auszug aus EGMR, 13.10.2009 - 27872/03
Referring in particular to the decision in the case of Bayram and Yıldırım v. Turkey (no. 38587/97, ECHR 2002-III), the Government submitted that the applicants, who claim that the investigation was ineffective, should have introduced their application within a reasonable time after the bodies of their relatives had been found in April 1994.The Court noted that it had held in the case of Bayram and Yıldırım v. Turkey ((dec.), no. 38587/97, ECHR 2002-III), referred to by the Government, and in a number of other similar cases that, if no domestic remedies were available or if they were judged to be ineffective, the six-month time-limit in principle ran from the date of the act complained of.

Verursachung des Todes eines Gefangenen in türkischer Haft - Umfang der …
Auszug aus EGMR, 13.10.2009 - 27872/03
In that connection, the Court points out that this obligation is not confined to cases where it is apparent that the killing was caused by an agent of the State (see Salman v. Turkey ([GC], no. 21986/93, § 105, ECHR 2000-VII). - EGMR, 31.05.2005 - 27693/95
CELIKBILEK v. TURKEY
Auszug aus EGMR, 13.10.2009 - 27872/03
Although the inadequacy of the investigation into the killing of their relatives will obviously have caused the applicants feelings of anguish and mental suffering, the Court considers that it has not been established that there were special factors which would justify finding a separate violation of Article 3 of the Convention in relation to the applicants (ibid, at § 239, and the cases cited therein; see also Dündar v. Turkey, no. 26972/95, § 91, 20 September 2005; Çelikbilek v. Turkey, no. 27693/95, §§ 98-99, 31 May 2005 and the case cited therein).

ACAR AND OTHERS v. TURKEY
Auszug aus EGMR, 13.10.2009 - 27872/03
In comparable cases such fears have been voiced a number of times by applicants and the Court has found that during emergency rule people were actually killed for not being willing to join the village guards (see, for example, Acar and Others v. Turkey (nos. 36088/97 and 38417/97, 24 May 2005). - EGMR, 06.10.2005 - 28299/95
NESIBE HARAN v. TURKEY
Auszug aus EGMR, 13.10.2009 - 27872/03
However, having regard to similar cases (see Nesibe Haran v. Turkey, no. 28299/95, § 107, 6 October 2005; see also Dündar, cited above, § 109), and deciding on an equitable basis, it awards each applicant EUR 10, 000 in respect of non-pecuniary damage. - EGMR, 20.09.2005 - 26972/95
DÜNDAR v.
- EGMR, 12.01.2006 - 18888/02
IÇYER c. TURQUIE
Auszug aus EGMR, 13.10.2009 - 27872/03
Referring to the decisions of inadmissibility in the cases of İçyer v. Turkey (no. 18888/02, 12 January 2006) and Uca v. Turkey (no. 3743/06, 29 April 2008), the Government argued that the applicants could no longer claim to be victims within the meaning of Article 34 of the Convention because they had applied for and received compensation for the deaths of their relatives. - EGMR, 27.11.2007 - 32457/04
BRECKNELL v. THE UNITED KINGDOM
Auszug aus EGMR, 13.10.2009 - 27872/03
To that end, the Court considered in its judgment in the case of Brecknell v. the United Kingdom (no. 32457/04, § 71, 27 November 2007) that, where there is a plausible or credible allegation, the discovery of any new piece of evidence or item of information relevant to the identification and eventual prosecution or punishment of the perpetrator of an unlawful killing, would require the authorities to take further investigative measures. - EGMR, 08.07.1999 - 23763/94
TANRIKULU c. TURQUIE
Auszug aus EGMR, 13.10.2009 - 27872/03
It could not therefore be regarded as an effective remedy within the meaning of Article 35 § 1 of the Convention (see, mutatis mutandis, Tanrıkulu v. Turkey [GC], no. 23763/94, § 79, ECHR 1999-IV). - EGMR, 28.05.2002 - 73065/01
BULUT and YAVUZ v. TURKEY
Auszug aus EGMR, 13.10.2009 - 27872/03
In that situation, the six-month period might be calculated from the time when the applicant becomes aware, or should have become aware, of these circumstances (see Bulut and Yavuz v. Turkey (dec.), no. 73065/01, 28 May 2002 and the cases cited therein). - EGMR, 08.01.2009 - 43326/05

UCA c. TURQUIE
- EGMR, 31.07.2012 - 23016/04
[ENG]
As regards the Government's objection based on the applicants" failure to seek compensation, the Court points out that it has already examined and rejected the Government's reliance on the above-mentioned Uca decision in two other cases which also concerned the issue of the right to life (see, mutatis mutandis, Gasyak and Others v. Turkey, no. 27872/03, §§ 66-72, 13 October 2009, and Fadime and Turan Karabulut v. Turkey, no. 23872/04, § 38, 27 May 2010). - EGMR, 12.07.2016 - 34661/07
MUCIBABIC v. SERBIA
Although there were adjournments and lulls in the judicial activity in this case, there were no periods of total inactivity allowing the Court to establish the date on which the applicant was or could have been aware that the remedies had become ineffective, given that he had consistently displayed the requisite interest in obtaining a concrete result and had continued his efforts by pursuing a subsidiary prosecution (see, by contrast, Gasyak and Others v. Turkey, no. 27872/03, § 58, 13 October 2009, and Narin v. Turkey, no. 18907/02, § 50, 15 December 2009). - EGMR, 11.03.2014 - 60441/13
GÜRTEKIN AND OTHERS v. CYPRUS
Even where events took place far in the past, it is possible that new developments occur such that a fresh obligation to investigate arises, for example, newly-discovered evidence comes to light (Brecknell v. the United Kingdom (no. 32457/04, §§ 73-75, 27 November 2007; Hackett v United Kingdom (no. 4698/04, (dec.) May 10, 2005; Gasyak and Others v. Turkey (no. 27872/03, 13 October 2009).
- EGMR, 10.07.2012 - 21099/06
[FRE]
- EGMR, 03.04.2012 - 46744/07
CHARALAMBOUS AND OTHERS v. TURKEY
Such a fresh obligation arose in Brecknell v. the United Kingdom (no. 32457/04, §§ 73-75, 27 November 2007) where, years after the original investigation ended, a witness came forward making plausible allegations about security force collusion in a sectarian killing; in Hackett v the United Kingdom (no. 4698/04, (dec.) May 10, 2005) where the person convicted of a murder made revelations years after his trial alleging his confession had been false, seeking to protect the real killer; and in Gasyak and Others v. Turkey (no. 27872/03, 13 October 2009) where the family brought to the attention of the authorities new evidence of the perpetrators of a killing. - EGMR, 09.12.2014 - 44814/07
BUDAK c. TURQUIE
Slovénie [GC], no 71463/01, §§ 161-163, 9 avril 2009). - EGMR, 19.06.2018 - 52577/15
TODOROVIC v. CROATIA
As to the steps taken after 24 September 2015, the Court reiterates that where information purportedly casting new light on the circumstances of a death comes into the public domain, a new obligation to investigate the death may arise (see Hackett v. the United Kingdom (dec.), no. 34698/04, 10 May 2005; Brecknell v. the United Kingdom, no. 32457/04, §§ 66-67, 27 November 2007; Williams v. the United Kingdom (dec.), no. 32567/06, 17 February 2009; Gasyak and Others v. Turkey, no. 27872/03, § 60, 13 October 2009; and Harrison and Others, cited above, § 51). - EGMR, 31.05.2011 - 1721/07
[ENG]
The determination of such a period by the Court depends on the circumstances of each case and other factors such as the diligence and interest displayed by the applicants (see, Gasyak and Others v. Turkey, no. 27872/03, § 58, 13 October 2009 and Narin v. Turkey, no. 18907/02, § 50, 15 December 2009). - EGMR, 08.12.2020 - 41317/15
SKRPAN v. CROATIA
In this connection, the Court emphasises that, even where events took place far in the past, whenever new developments occur, for example newly discovered evidence comes to light (see Brecknell v. the United Kingdom, no. 32457/04, §§ 73-75, 27 November 2007; Gasyak and Others v. Turkey, no. 27872/03, § 60, 13 October 2009), the obligation to investigate revives. - EGMR, 11.06.2020 - 32349/16
VUJNOVIC v. CROATIA
In this connection, the Court reiterates that where information purportedly casting new light on the circumstances of a death comes into the public domain, a new obligation to investigate the death may arise (see Hackett v. the United Kingdom (dec.), no. 34698/04, 10 May 2005; Brecknell v. the United Kingdom, no. 32457/04, §§ 66-67, 27 November 2007; Williams v. the United Kingdom (dec.), no. 32567/06, 17 February 2009; and Gasyak and Others v. Turkey, no. 27872/03, § 60, 13 October 2009). - EGMR, 31.05.2011 - 3025/06
