Espagne [GC], n° 30544/96, § 28, CEDH 1999-I). - EKMR, 16.12.1974 - 5849/72
MÜLLER v. AUSTRIA
- EKMR, 04.03.1985 - 10671/83

BÉLÁNÉ NAGY v. HUNGARY
In a number of cases the Court has endeavoured to assess all the relevant elements against the specific background (see Stefanetti and Others, cited above, § 59, with examples and further references; see also Domalewski, v. Poland (dec.), no. 34610/97, ECHR 1999-V). - EGMR, 24.01.2012 - 11838/07
[ENG]
Nor does it guarantee, as such, any right to a pension of a particular amount (see, for example, Kjartan Ásmundsson v. Iceland, no. 60669/00, § 39, ECHR 2004-IX; Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V; and Jankovic v. Croatia (dec.), no. 43440/98, ECHR 2000-X).One of the considerations in the assessment under this provision is whether the applicant's right to derive benefits from the social insurance scheme in question has been infringed in a manner resulting in the impairment of the essence of that pension right (see Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V and Kjartan Ásmundsson, cited above, § 39).

Moreover, the Court attaches importance to the fact that the social insurance benefits enjoyed by Mr Iwaszkiewicz originated from a privileged status which has been, and still is, perceived as a special honour (see Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V and Skórkiewicz v. Poland (dec.), no. 39860/98, 1 June 1999). - EGMR, 25.10.2011 - 2033/04
VALKOV AND OTHERS v. BULGARIA
In that regard, it would also be important to verify whether an applicant's right to derive benefits from the social security scheme in question has been infringed in a manner resulting in the impairment of the essence of his pension rights (see Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V; Kjartan Ásmundsson, cited above, § 39 in fine; and Wieczorek, cited above, § 57 in fine). - EGMR, 28.04.2009 - 38886/05
RASMUSSEN v. POLAND
The same approach was followed by the Court itself in the case of Domalewski, in which it was noted that "the applicant's pecuniary rights stemming from the contributions paid into her pension scheme remained the same" and that "the applicant's right to derive benefits from the social insurance scheme was [not] infringed in a manner contrary to Article 1 of Protocol No. 1, especially as the loss of "veteran status" did not result in the essence of his pension rights being impaired (see Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V; see also, Slavicinsky v. the Czech Republic (dec. ), no. 10072/05, 20 November 2006). - EGMR, 19.01.2023 - 32667/19
DOMENECH ARADILLA v. SPAIN
An important consideration is whether the applicant's right to derive benefits from the social insurance scheme in question has been infringed in a manner resulting in the impairment of the essence of his or her pension rights (see Domalewski v. Poland (dec.), no. 34610/97, ECHR 1999-V; Kjartan Ásmundsson, cited above, § 39; and Wieczorek, § 57, 8 December 2009; among many others). - EGMR, 12.10.2000 - 43440/98 The Court therefore considers that the complaint falls to be examined under Article 1 of Protocol No. 1 to the Convention read together with Article 14 of the Convention (see, mutatis mutandis, the Gaygusuz judgment, cited above, §§ 39-41, and Domalewski v. Poland (dec.), no. 34610/97, ECHR, 2000).

VALVERDE DIGON v.
- EGMR, 15.04.2014 - 21838/10
